A BILL TO BE ENTITLED
AN ACT
relating to the authority of the Harris County Improvement District
No. 6 to impose an impact fee or assessment on certain service
providers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 3843.207, Special District Local Laws
Code, is amended to read as follows:
Sec. 3843.207. PROPERTY OF CERTAIN UTILITIES OR SERVICE
PROVIDERS EXEMPT FROM ASSESSMENT AND IMPACT FEES. (a) The
district may not impose an impact fee or assessment on the property,
including equipment or facilities, of:
(1) an electric utility as defined by Section 31.002,
Utilities Code;
(2) a gas utility as defined by Section 101.003 or
121.001, Utilities Code;
(3) a telecommunications provider as defined by
Section 51.002, Utilities Code; [or]
(4) a cable operator as defined by 47 U.S.C. Section
522, as amended; or
(5) a public radio station.
(b) In this section, "public radio station" means a business
or enterprise that provides radio broadcasting services to the
public and receives a majority of its funding through donations of
money from listeners.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
