77 relating to court-appointed volunteer advocates in certain suits
88 affecting the parent-child relationship.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.601(2), Family Code, is amended to
1111 read as follows:
1212 (2) "Volunteer advocate program" means a
1313 volunteer-based, nonprofit program that:
1414 (A) provides advocacy services to abused or
1515 neglected children with the goal of obtaining a permanent placement
1616 for a child that is in the child's best interest; and
1717 (B) complies with recognized standards for
1818 volunteer advocate programs.
1919 SECTION 2. Section 264.602, Family Code, is amended by
2020 amending Subsection (a) and adding Subsection (f) to read as
2121 follows:
2222 (a) The statewide organization with which the attorney
2323 general contracts under Section 264.603 shall contract for services
2424 with eligible volunteer advocate programs to provide advocacy
2525 services to abused or neglected children [expand the existing
2626 services of the programs].
2727 (f) Expenses incurred by a volunteer advocate program to
2828 promote public awareness of the need for volunteer advocates or to
2929 explain the work performed by volunteer advocates are not
3030 considered administrative expenses for the purpose of Section
3131 264.603(b).
3232 SECTION 3. Section 264.603(a), Family Code, is amended to
3333 read as follows:
3434 (a) The attorney general shall contract with one statewide
3535 organization of individuals or groups of individuals who have
3636 expertise in the dynamics of child abuse and neglect and experience
3737 in operating volunteer advocate programs to provide training,
3838 technical assistance, and evaluation services for the benefit of
3939 local volunteer advocate programs. The contract shall:
4040 (1) include [require] measurable goals and objectives
4141 relating to the number of:
4242 (A) volunteer advocates in the program; and
4343 (B) children receiving services from the
4444 program; and
4545 (2) follow practices designed to ensure compliance
4646 with standards referenced in the contract [for expanding local
4747 volunteer child advocate programs to areas of the state in which
4848 those programs do not exist].
4949 SECTION 4. Section 264.604(a), Family Code, is amended to
5050 read as follows:
5151 (a) A person is eligible for a contract under Section
5252 264.602 only if the person is a public or private nonprofit entity
5353 that operates a volunteer advocate program that:
5454 (1) uses individuals appointed as volunteer advocates
5555 or guardians ad litem by the court to provide for the needs of
5656 abused or neglected children;
5757 (2) has provided court-appointed advocacy services
5858 for at least six months [two years];
5959 (3) provides court-appointed advocacy services for at
6060 least 10 children each month; and
6161 (4) has demonstrated that the program has local
6262 judicial support.
6363 SECTION 5. The following provisions of the Family Code are
6464 repealed:
6565 (1) Section 264.602(c); and
6666 (2) Sections 264.607(b) and (c).
6767 SECTION 6. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2009.
