| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 8822.023(d), Special District Local Laws | |
| 11 | 11 | Code, is amended to read as follows: | |
| 12 | 12 | (d) If a majority of the votes cast at the election are not | |
| 13 | 13 | in favor of creation of the district, the elected directors shall | |
| 14 | 14 | take office as temporary directors and may hold a subsequent | |
| 15 | 15 | confirmation election on any [the] uniform election date in [May] | |
| 16 | 16 | 2010 or 2012. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2009. |
