A BILL TO BE ENTITLED
AN ACT
relating to the date of an election to confirm the creation of the
Lavaca County Groundwater Conservation District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 8822.023(d), Special District Local Laws
Code, is amended to read as follows:
(d) If a majority of the votes cast at the election are not
in favor of creation of the district, the elected directors shall
take office as temporary directors and may hold a subsequent
confirmation election on any [the] uniform election date in [May]
2010 or 2012.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
