66 AN ACT
77 relating to the board of directors of the Kenedy County Groundwater
88 Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1152, Acts of the 78th Legislature,
1111 Regular Session, 2003, is amended by adding Section 9A to read as
1212 follows:
1313 Sec. 9A. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
1414 DISTRICTS. (a) As soon as practicable after the effective date of
1515 the Act by which this section is enacted into law, the board shall:
1616 (1) divide the district into five single-member
1717 districts for electing directors; and
1818 (2) assign each of the existing board positions to one
1919 of the new single-member districts.
2020 (b) If the district annexes territory, the annexed
2121 territory becomes part of one or more of the single-member
2222 districts as determined by the board.
2323 (c) One director shall be elected from each single-member
2424 district.
2525 (d) To be a candidate for or to serve as a director, a person
2626 must be a registered voter in the single-member district the person
2727 represents or seeks to represent.
2828 (e) A person shall indicate on the application for a place
2929 on the ballot the single-member district the person seeks to
3030 represent.
3131 (f) After each federal decennial census or as needed, the
3232 board may redraw the single-member districts to reflect population
3333 changes. A director in office on the effective date of a change in
3434 the boundaries of a single-member district, or a director elected
3535 or appointed before the effective date of the change whose term of
3636 office begins on or after the effective date of the change, shall
3737 serve for the remainder of the director's term in the single-member
3838 district to which elected or appointed even though the change in
3939 boundaries places the director's residence outside the district to
4040 which the director was elected or appointed.
4141 SECTION 2. Chapter 1162, Acts of the 78th Legislature,
4242 Regular Session, 2003, is amended by adding Section 8A to read as
4343 follows:
4444 Sec. 8A. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
4545 DISTRICTS. (a) As soon as practicable after the effective date of
4646 the Act by which this section is enacted into law, the board shall:
4747 (1) divide the district into five single-member
4848 districts for electing directors; and
4949 (2) assign each of the existing board positions to one
5050 of the new single-member districts.
5151 (b) If the district annexes territory, the annexed

5353 districts as determined by the board.
5454 (c) One director shall be elected from each single-member
5555 district.
5656 (d) To be a candidate for or to serve as a director, a person

7272 SECTION 3. The following laws are repealed:
7373 (1) Section 9, Chapter 1152, Acts of the 78th
7474 Legislature, Regular Session, 2003; and
7575 (2) Section 8, Chapter 1162, Acts of the 78th
7676 Legislature, Regular Session, 2003.
7777 SECTION 4. (a) The change in law made by this Act applies
7878 only to a director elected or appointed to serve on the board of
7979 directors of the Kenedy County Groundwater Conservation District on
8080 or after the effective date of this Act.
8181 (b) The change in law made by this Act does not affect the
8282 term of office of a director serving on the board of directors of
8383 the Kenedy County Groundwater Conservation District on the
8484 effective date of this Act.
8585 SECTION 5. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2009.
