7	7	relating to the board of directors of the Kenedy County Groundwater
8	8	Conservation District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 1152, Acts of the 78th Legislature,
11	11	Regular Session, 2003, is amended by adding Section 9A to read as
12	12	follows:
13	13	Sec. 9A. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
14	14	DISTRICTS. (a) As soon as practicable after the effective date of
15	15	the Act by which this section is enacted into law, the board shall:
16	16	(1) divide the district into five single-member
17	17	districts for electing directors; and
18	18	(2) assign each of the existing board positions to one
19	19	of the new single-member districts.
20	20	(b) If the district annexes territory, the annexed
21	21	territory becomes part of one or more of the single-member
22	22	districts as determined by the board.
23	23	(c) One director shall be elected from each single-member
24	24	district.
25	25	(d) To be a candidate for or to serve as a director, a person
26	26	must be a registered voter in the single-member district the person
27	27	represents or seeks to represent.
28	28	(e) A person shall indicate on the application for a place
29	29	on the ballot the single-member district the person seeks to
30	30	represent.
31	31	(f) After each federal decennial census or as needed, the
32	32	board may redraw the single-member districts to reflect population
33	33	changes. A director in office on the effective date of a change in
34	34	the boundaries of a single-member district, or a director elected
35	35	or appointed before the effective date of the change whose term of
36	36	office begins on or after the effective date of the change, shall
37	37	serve for the remainder of the director's term in the single-member
38	38	district to which elected or appointed even though the change in
39	39	boundaries places the director's residence outside the district to
40	40	which the director was elected or appointed.
41	41	SECTION 2. Chapter 1162, Acts of the 78th Legislature,
42	42	Regular Session, 2003, is amended by adding Section 8A to read as
43	43	follows:

72	72	SECTION 3. The following laws are repealed:
73	73	(1) Section 9, Chapter 1152, Acts of the 78th
74	74	Legislature, Regular Session, 2003; and
75	75	(2) Section 8, Chapter 1162, Acts of the 78th
76	76	Legislature, Regular Session, 2003.
77	77	SECTION 4. (a) The change in law made by this Act applies
78	78	only to a director elected or appointed to serve on the board of
79	79	directors of the Kenedy County Groundwater Conservation District on
80	80	or after the effective date of this Act.
81	81	(b) The change in law made by this Act does not affect the
82	82	term of office of a director serving on the board of directors of
83	83	the Kenedy County Groundwater Conservation District on the
84	84	effective date of this Act.
85	85	SECTION 5. This Act takes effect immediately if it receives
86	86	a vote of two-thirds of all the members elected to each house, as
87	87	provided by Section 39, Article III, Texas Constitution. If this
88	88	Act does not receive the vote necessary for immediate effect, this
89	89	Act takes effect September 1, 2009.
