| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter C, Chapter 501, Business & Commerce |
|---|
| 9 | 9 | | Code, as effective April 1, 2009, is amended by adding Section |
|---|
| 10 | 10 | | 501.1011 to read as follows: |
|---|
| 11 | 11 | | Sec. 501.1011. SALES RECEIPT CONTAINING DRIVER'S LICENSE |
|---|
| 12 | 12 | | NUMBER PROHIBITED. A person may not print an individual's driver's |
|---|
| 13 | 13 | | license number on a receipt that evidences payment for a sale of |
|---|
| 14 | 14 | | goods or services and is provided to the individual. |
|---|
| 15 | 15 | | SECTION 2. Section 501.102, Business & Commerce Code, as |
|---|
| 16 | 16 | | effective April 1, 2009, is amended by amending Subsection (a) and |
|---|
| 17 | 17 | | adding Subsection (a-1) to read as follows: |
|---|
| 18 | 18 | | (a) A person who violates Section 501.101 [this subchapter] |
|---|
| 19 | 19 | | is liable to this state for a civil penalty in an amount not to |
|---|
| 20 | 20 | | exceed $500 for each violation. The attorney general or the |
|---|
| 21 | 21 | | prosecuting attorney in the county in which the violation occurs |
|---|
| 22 | 22 | | may bring an action to recover the civil penalty imposed under this |
|---|
| 23 | 23 | | subsection [section]. |
|---|
| 24 | 24 | | (a-1) A person who violates Section 501.1011 is liable to |
|---|
| 25 | 25 | | this state for a civil penalty in an amount not to exceed $500 for |
|---|
| 26 | 26 | | each calendar month in which a violation occurs. The civil penalty |
|---|
| 27 | 27 | | may not be imposed for more than one violation that occurs in a |
|---|
| 28 | 28 | | month. The attorney general or the prosecuting attorney in the |
|---|
| 29 | 29 | | county in which the violation occurs may bring an action to recover |
|---|
| 30 | 30 | | the civil penalty imposed under this subsection. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect January 1, 2010. |
