77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 501, Business & Commerce
99 Code, as effective April 1, 2009, is amended by adding Section
1010 501.1011 to read as follows:
1111 Sec. 501.1011. SALES RECEIPT CONTAINING DRIVER'S LICENSE
1212 NUMBER PROHIBITED. A person may not print an individual's driver's
1313 license number on a receipt that evidences payment for a sale of
1414 goods or services and is provided to the individual.
1515 SECTION 2. Section 501.102, Business & Commerce Code, as
1616 effective April 1, 2009, is amended by amending Subsection (a) and
1717 adding Subsection (a-1) to read as follows:
1818 (a) A person who violates Section 501.101 [this subchapter]
1919 is liable to this state for a civil penalty in an amount not to
2020 exceed $500 for each violation. The attorney general or the
2121 prosecuting attorney in the county in which the violation occurs
2222 may bring an action to recover the civil penalty imposed under this
2323 subsection [section].
2424 (a-1) A person who violates Section 501.1011 is liable to
2525 this state for a civil penalty in an amount not to exceed $500 for
2626 each calendar month in which a violation occurs. The civil penalty
2727 may not be imposed for more than one violation that occurs in a
2828 month. The attorney general or the prosecuting attorney in the
2929 county in which the violation occurs may bring an action to recover
3030 the civil penalty imposed under this subsection.
3131 SECTION 3. This Act takes effect January 1, 2010.
