99 relating to employment qualifications and compensation of certain
1010 county employees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 152.071(a) and (b), Local Government
1313 Code, are amended to read as follows:
1414 (a) In a county with a population of more than 75,000, the
1515 county government shall classify all positions in its sheriff's
1616 department and shall specify the duties and job qualifications and
1717 prescribe the salary for each classification. A person hired for a
1818 position that requires the person to be licensed by the state is not
1919 eligible to receive the prescribed salary for the position until
2020 the person fulfills the licensing requirement.
2121 (b) A member of the sheriff's department who meets the job
2222 qualifications and who is required to perform the duties of a
2323 particular classification is entitled to be paid the salary
2424 prescribed for that position during the time the member performs
2525 those duties, except that a member who performs the duties of a
2626 classification for which the member was not initially hired is not
2727 entitled to be paid the salary prescribed for performing those
2828 duties unless the payment is authorized by the commissioners court
2929 before the duties are performed.
3030 SECTION 2. Sections 155.002(a) and (b), Local Government
3131 Code, are amended to read as follows:
3232 (a) A request for a payroll deduction must:
3333 (1) be in writing;
3434 (2) be submitted to the county auditor unless the
3535 deduction is processed through an automated payroll system
3636 maintained by the county; and
3737 (3) state the amount to be deducted and the entity to
3838 which the amount is to be transferred.
3939 (b) A request remains in effect until:
4040 (1) the county auditor receives a written notice of
4141 revocation signed by the employee; or
4242 (2) the deduction is revoked by the employee through
4343 an automated payroll system maintained by the county.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2009.
