 A BILL TO BE ENTITLED
 AN ACT
 relating to the regulation of massage establishments in certain
 counties.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter E, Chapter 455, Occupations Code, is
 amended by adding Section 455.2021 to read as follows:
 Sec. 455.2021.  MASSAGE ESTABLISHMENT HOURS OF OPERATION.
 (a)  This section applies only to massage establishments located in
 a county with a population of 3.3 million or more.
 (b)  Except as provided by Subsection (c), a massage
 establishment may provide services only between the hours of 7 a.m.
 and 10 p.m.
 (c)  On application by a massage establishment, the
 commissioners court of the county in which the massage
 establishment is located may exempt the massage establishment from
 the requirement of Subsection (b).
 (d)  The entrance doors to a massage establishment may not be
 equipped with an electronic locking device that can be temporarily
 disengaged from a remote location.
 SECTION 2. This Act takes effect September 1, 2009.
