77 relating to requiring warning signs regarding mercury levels in

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 437, Health and Safety Code, is amended
1111 by adding Section 437.022 to read as follows:
1212 Sec. 437.022. WARNING SIGN REGARDING MERCURY LEVELS IN
1313 CERTAIN FISH. (a) A retail fish dealer shall post a warning sign in
1414 a conspicuous location where it is readily visible by persons
1515 purchasing fresh or previously frozen fish. The department by rule
1616 shall specify the size and graphic design of the sign. The sign
1717 must contain the following wording:
1818 ATTENTION WOMEN CONSIDERING BECOMING PREGNANT, PREGNANT
1919 WOMEN, NURSING MOTHERS, AND PARENTS OF YOUNG CHILDREN
2020 Some fish and shellfish, especially large fish such as shark,
2121 swordfish, king mackerel, and tilefish, may contain high levels of
2222 mercury that may harm the developing nervous system of a child.
2323 For more information about the risks of mercury in fish and
2424 shellfish call the Texas Department of State Health Services' food
2525 information line toll-free at (insert toll-free telephone number).
2626 (b) The department shall adopt rules to administer this
2727 section.
2828 SECTION 2. This Act takes effect September 1, 2009.
