77 relating to the waiting period for issuing a decree in certain suits
88 for divorce.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 6.702, Family Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) Except as provided by Subsection (c), the [The] court
1414 may not grant a divorce before the 60th day after the date the suit
1515 was filed. A decree rendered in violation of this subsection is not
1616 subject to collateral attack.
1717 (c) A waiting period is not required under Subsection (a)
1818 before a court may grant a divorce in a suit in which:
1919 (1) the respondent has been finally convicted of an
2020 offense an element of which included the respondent assaulting or
2121 threatening the petitioner; or
2222 (2) there is evidence sufficient for the court to find
2323 that the respondent committed family violence during the marriage,
2424 including evidence that:
2525 (A) a temporary order has been issued against the
2626 respondent under Subchapter F; or
2727 (B) the petitioner has obtained a protective
2828 order under Title 4 against the respondent because of family
2929 violence.
3030 SECTION 2. The change in law made by this Act applies only
3131 to a suit for dissolution of a marriage filed on or after the
3232 effective date of this Act. A suit for dissolution of a marriage
3333 filed before the effective date of this Act is governed by the law
3434 in effect on the date the suit was filed, and the former law is
3535 continued in effect for that purpose.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
