| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Chapter 430, Local Government Code, is amended |
|---|
| 14 | 14 | | by adding Section 430.004 to read as follows: |
|---|
| 15 | 15 | | Sec. 430.004. REQUEST FOR INDEPENDENT REVIEW OF PROPOSED |
|---|
| 16 | 16 | | FACILITY TO SUPPLY DRINKING WATER. (a) In this section, "facility |
|---|
| 17 | 17 | | to supply drinking water" includes an intake facility, a pumping |
|---|
| 18 | 18 | | facility, a storage facility, a pipeline, and any other facility to |
|---|
| 19 | 19 | | withdraw, transport, or otherwise deliver drinking water. |
|---|
| 20 | 20 | | (b) Before a person may begin construction of a facility to |
|---|
| 21 | 21 | | supply drinking water with a value greater than $100 million, the |
|---|
| 22 | 22 | | person shall: |
|---|
| 23 | 23 | | (1) at the request of a municipality or other local |
|---|
| 24 | 24 | | government in whose boundaries the facility will be located, |
|---|
| 25 | 25 | | contract for an independent review of the facility that examines |
|---|
| 26 | 26 | | the scope of the project, the benefits of the facility to the |
|---|
| 27 | 27 | | municipality or other local government, and the effect of the |
|---|
| 28 | 28 | | facility on the individuals in the municipality or other local |
|---|
| 29 | 29 | | government who would be affected by the facility; and |
|---|
| 30 | 30 | | (2) provide a copy of the review to the requesting |
|---|
| 31 | 31 | | entity and any other local government that may be affected by the |
|---|
| 32 | 32 | | facility. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
