99 relating to an independent review of a proposed facility to supply
1010 drinking water requested by certain municipalities and other local
1111 governments.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 430, Local Government Code, is amended
1414 by adding Section 430.004 to read as follows:
1515 Sec. 430.004. REQUEST FOR INDEPENDENT REVIEW OF PROPOSED
1616 FACILITY TO SUPPLY DRINKING WATER. (a) In this section, "facility
1717 to supply drinking water" includes an intake facility, a pumping
1818 facility, a storage facility, a pipeline, and any other facility to
1919 withdraw, transport, or otherwise deliver drinking water.
2020 (b) Before a person may begin construction of a facility to
2121 supply drinking water with a value greater than $100 million, the
2222 person shall:
2323 (1) at the request of a municipality or other local
2424 government in whose boundaries the facility will be located,
2525 contract for an independent review of the facility that examines
2626 the scope of the project, the benefits of the facility to the
2727 municipality or other local government, and the effect of the
2828 facility on the individuals in the municipality or other local
2929 government who would be affected by the facility; and
3030 (2) provide a copy of the review to the requesting
3131 entity and any other local government that may be affected by the
3232 facility.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2009.
