| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 504.409, Transportation Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | Sec. 504.409. [VOLUNTEER] FIREFIGHTERS. (a) The | |
| 13 | 13 | department shall issue specialty license plates for: | |
| 14 | 14 | (1) volunteer firefighters certified by: | |
| 15 | 15 | (A) [(1)] the Texas Commission on Fire | |
| 16 | 16 | Protection; or | |
| 17 | 17 | (B) [(2)] the State Firemen's and Fire Marshals' | |
| 18 | 18 | Association of Texas; and | |
| 19 | 19 | (2) fire protection personnel as that term is defined | |
| 20 | 20 | by Section 419.021, Government Code. | |
| 21 | 21 | (b) The fee for issuance of each set of [the] license plates | |
| 22 | 22 | is: | |
| 23 | 23 | (1) $4 for volunteer firefighters; and | |
| 24 | 24 | (2) $30 for fire protection personnel. | |
| 25 | 25 | (c) A person may be issued not more than three sets [only one | |
| 26 | 26 | set] of [the] license plates. | |
| 27 | 27 | SECTION 2. This Act takes effect immediately if it receives | |
| 28 | 28 | a vote of two-thirds of all the members elected to each house, as | |
| 29 | 29 | provided by Section 39, Article III, Texas Constitution. If this | |
| 30 | 30 | Act does not receive the vote necessary for immediate effect, this | |
| 31 | 31 | Act takes effect September 1, 2009. |
