| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle C, Title 9, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 797 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 797. SALE OF TOY-LIKE LIGHTERS PROHIBITED |
|---|
| 13 | 13 | | Sec. 797.001. DEFINITION. In this chapter, "toy-like |
|---|
| 14 | 14 | | lighter" means a mechanical or electrical device typically used for |
|---|
| 15 | 15 | | lighting cigarettes, cigars, or pipes that resembles in physical |
|---|
| 16 | 16 | | form or function articles designed or intended for play by children |
|---|
| 17 | 17 | | under 10 years of age. The term includes lighters that resemble |
|---|
| 18 | 18 | | cartoon characters, telephones, guns, watches, weapons, furniture, |
|---|
| 19 | 19 | | sports equipment, tools, holiday decorations, musical instruments, |
|---|
| 20 | 20 | | vehicles, or toy animals or play musical notes or have flashing |
|---|
| 21 | 21 | | lights. |

| 22 | 22 | | Sec. 797.002. APPLICABILITY OF CHAPTER. This chapter does |
|---|
| 23 | 23 | | not apply to: |
|---|
| 24 | 24 | | (1) a lighter that: |
|---|
| 25 | 25 | | (A) was manufactured before January 1, 1980; |
|---|
| 26 | 26 | | (B) does not contain fuel; and |
|---|
| 27 | 27 | | (C) does not have a device necessary to produce |
|---|
| 28 | 28 | | combustion or a flame; |
|---|
| 29 | 29 | | (2) a mechanical or electrical device used primarily |
|---|
| 30 | 30 | | to ignite fuel for a fireplace or a charcoal or gas grill; or |
|---|
| 31 | 31 | | (3) a disposable or refillable lighter printed or |
|---|
| 32 | 32 | | decorated with a logo, label, decal, artwork, or heat-shrinkable |
|---|
| 33 | 33 | | sleeve or designed as a souvenir to resemble an icon of a |
|---|
| 34 | 34 | | destination. |
|---|
| 35 | 35 | | Sec. 797.003. SALE OR DISTRIBUTION OF TOY-LIKE LIGHTERS |
|---|
| 36 | 36 | | PROHIBITED. A person may not sell or distribute for retail sale or |
|---|
| 37 | 37 | | promotion in this state a toy-like lighter. |
|---|
| 38 | 38 | | Sec. 797.004. TRANSPORTATION AND STORAGE PERMITTED. This |
|---|
| 39 | 39 | | chapter does not prohibit the transportation of toy-like lighters |
|---|
| 40 | 40 | | through this state or the storage of toy-like lighters in a |
|---|
| 41 | 41 | | warehouse or distribution center closed to the public. |
|---|
| 42 | 42 | | Sec. 797.005. ADMINISTRATION OF CHAPTER. The state fire |
|---|
| 43 | 43 | | marshal may adopt rules to administer this chapter. |
|---|
| 44 | 44 | | Sec. 797.006. OFFENSE. (a) A person commits an offense if |
|---|
| 45 | 45 | | the person violates this chapter or a rule adopted under this |
|---|
| 46 | 46 | | chapter. |
|---|
| 47 | 47 | | (b) An offense under this chapter is a Class C misdemeanor. |
|---|
| 48 | 48 | | SECTION 2. This Act takes effect September 1, 2009. |
