55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to notice requirements in certain counties for hearings in
88 suits for dissolution of marriage and suits affecting the
99 parent-child relationship.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter E, Chapter 6, Family Code, is amended
1212 by adding Section 6.412 to read as follows:
1313 Sec. 6.412. NOTICE OF HEARING DATE. (a) This section
1414 applies only to a court in a county with a population of one million
1515 or more.
1616 (b) The court shall give notice of the date of a hearing in a
1717 suit for dissolution of a marriage in accordance with Section
1818 105.0031.
1919 SECTION 2. Chapter 105, Family Code, is amended by adding
2020 Section 105.0031 to read as follows:
2121 Sec. 105.0031. NOTICE OF HEARING DATE. (a) This section
2222 applies only to a court in a county with a population of one million
2323 or more.
2424 (b) After a hearing date on a petition or motion in a
2525 proceeding filed under this title is set, the court shall promptly
2626 give written notice of the hearing date to the petitioner or movant.
2727 (c) Notwithstanding Section 22.004, Government Code, the
2828 supreme court may not amend or adopt rules in conflict with this
2929 section.
3030 SECTION 3. The change in law made by this Act applies only
3131 to a petition or motion filed on or after the effective date of this
3232 Act. A petition or motion filed before that date is governed by the
3333 law in effect immediately before that date, and the former law is
3434 continued in effect for that purpose.
3535 SECTION 4. This Act takes effect September 1, 2009.
