| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter E, Chapter 6, Family Code, is amended |
|---|
| 12 | 12 | | by adding Section 6.412 to read as follows: |
|---|
| 13 | 13 | | Sec. 6.412. NOTICE OF HEARING DATE. (a) This section |
|---|
| 14 | 14 | | applies only to a court in a county with a population of one million |
|---|
| 15 | 15 | | or more. |
|---|
| 16 | 16 | | (b) The court shall give notice of the date of a hearing in a |
|---|
| 17 | 17 | | suit for dissolution of a marriage in accordance with Section |
|---|
| 18 | 18 | | 105.0031. |
|---|
| 19 | 19 | | SECTION 2. Chapter 105, Family Code, is amended by adding |
|---|
| 20 | 20 | | Section 105.0031 to read as follows: |
|---|
| 21 | 21 | | Sec. 105.0031. NOTICE OF HEARING DATE. (a) This section |
|---|
| 22 | 22 | | applies only to a court in a county with a population of one million |
|---|
| 23 | 23 | | or more. |
|---|
| 24 | 24 | | (b) After a hearing date on a petition or motion in a |
|---|
| 25 | 25 | | proceeding filed under this title is set, the court shall promptly |
|---|
| 26 | 26 | | give written notice of the hearing date to the petitioner or movant. |
|---|
| 27 | 27 | | (c) Notwithstanding Section 22.004, Government Code, the |
|---|
| 28 | 28 | | supreme court may not amend or adopt rules in conflict with this |
|---|
| 29 | 29 | | section. |
|---|
| 30 | 30 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to a petition or motion filed on or after the effective date of this |
|---|
| 32 | 32 | | Act. A petition or motion filed before that date is governed by the |
|---|
| 33 | 33 | | law in effect immediately before that date, and the former law is |
|---|
| 34 | 34 | | continued in effect for that purpose. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect September 1, 2009. |
