| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 254.0311, Election Code, is amended by | |
| 11 | 11 | amending Subsection (c) and adding Subsection (i) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (c) If no reportable activity occurs during a reporting | |
| 14 | 14 | period, the legislative caucus is not required to file a report for | |
| 15 | 15 | that period [shall indicate that fact in the report]. | |
| 16 | 16 | (i) A member of a legislative caucus is not personally | |
| 17 | 17 | responsible for the filing of a report required by this section. | |
| 18 | 18 | Only the legislative caucus as an entity and any person appointed by | |
| 19 | 19 | the caucus to serve as treasurer of the caucus are subject to a | |
| 20 | 20 | penalty imposed under this chapter or Chapter 571, Government Code, | |
| 21 | 21 | for failure to comply with this section. | |
| 22 | 22 | SECTION 2. The changes in law made by this Act apply only to | |
| 23 | 23 | a report of contributions to and expenditures by a legislative | |
| 24 | 24 | caucus that is required to be filed on or after the effective date | |
| 25 | 25 | of this Act. A report that is required to be filed before that date | |
| 26 | 26 | is governed by the law in effect when the report was filed, and the | |
| 27 | 27 | former law is continued in effect for that purpose. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2009. |
