55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reports of contributions and expenditures by
88 legislative caucuses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 254.0311, Election Code, is amended by
1111 amending Subsection (c) and adding Subsection (i) to read as
1212 follows:
1313 (c) If no reportable activity occurs during a reporting
1414 period, the legislative caucus is not required to file a report for
1515 that period [shall indicate that fact in the report].
1616 (i) A member of a legislative caucus is not personally
1717 responsible for the filing of a report required by this section.
1818 Only the legislative caucus as an entity and any person appointed by
1919 the caucus to serve as treasurer of the caucus are subject to a
2020 penalty imposed under this chapter or Chapter 571, Government Code,
2121 for failure to comply with this section.
2222 SECTION 2. The changes in law made by this Act apply only to
2323 a report of contributions to and expenditures by a legislative
2424 caucus that is required to be filed on or after the effective date
2525 of this Act. A report that is required to be filed before that date
2626 is governed by the law in effect when the report was filed, and the
2727 former law is continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2009.
