55 CONCURRENT RESOLUTION
66 WHEREAS, The Texas Legislature for each of the last 13
77 regular sessions has adopted a concurrent resolution authorizing
88 the creation and appointment of joint interim legislative study
99 committees by the lieutenant governor and speaker of the house of
1010 representatives; and
1111 WHEREAS, Renewal of the prior authorizations to the presiding
1212 officers enables the legislature to address and study issues that
1313 remain unresolved on sine die adjournment or that emerge subsequent
1414 to that time; and
1515 WHEREAS, It is also desirable to adopt by resolution various
1616 rules and policies regarding the operation of joint committees to
1717 supplement, and reconcile differences between, the senate and house
1818 rules of procedure; now, therefore, be it
1919 RESOLVED, That the 81st Legislature of the State of Texas
2020 hereby authorize the lieutenant governor and speaker of the house
2121 of representatives to create by mutual agreement such joint
2222 committees as they consider necessary during the term of this
2323 legislature; and, be it further
2424 RESOLVED, That each joint committee created pursuant to this
2525 resolution be composed of such combination of legislators, state
2626 officials, or citizen members as shall be determined mutually by
2727 the presiding officers of each house; and, be it further
2828 RESOLVED, That on the request of the presiding officers, the
2929 governor may appoint members to a joint committee created pursuant
3030 to this resolution; and, be it further
3131 RESOLVED, That the presiding officers issue for each
3232 committee so created a joint proclamation identifying the issue or
3333 issues to be studied and listing the committee membership or
3434 describing the committee composition and that the proclamation be
3535 filed with the secretary of the senate and the chief clerk of the
3636 house of representatives; and, be it further
3737 RESOLVED, That the presiding officers designate jointly a
3838 chair, or designate alternatively two co-chairs, from among the
3939 committee membership; and, be it further
4040 RESOLVED, That the chair or co-chairs, acting jointly and
4141 within four weeks of the proclamation, prepare and present to the
4242 presiding officers a proposal for budget and staffing; and, be it
4343 further
4444 RESOLVED, That the chair or co-chairs be directed to use to
4545 the greatest extent possible the existing staff and administrative
4646 resources of committee members, standing committees, officers of
4747 the senate and house, and legislative service agencies; and, be it
4848 further
4949 RESOLVED, That the presiding officers jointly review each
5050 budget and staffing proposal, adopt budgetary and staffing
5151 allocations, and determine the manner in which each joint committee
5252 is to be funded; and, be it further
5353 RESOLVED, That the joint committee chair, or the co-chairs
5454 acting by mutual agreement, have authority to create and appoint
5555 subcommittees or affiliated advisory panels and to designate
5656 respective chairs for each, contingent on the advance approval of
5757 the presiding officers for the creation and appointment of
5858 subcommittees or advisory panels containing membership external to
5959 the committee; and, be it further
6060 RESOLVED, That each joint committee, and its subcommittees
6161 and advisory panels, convene at the call of its chair or co-chairs;
6262 provided that no joint committee, nor its subcommittees or advisory
6363 panels, shall convene in a public hearing or other meeting for the
6464 transaction of business unless public notice has been posted by its
6565 chair or co-chairs at the locations specified by the senate and
6666 house rules of procedure for posting of notice of standing
6767 committee meetings at least five calendar days in advance of the
6868 hearing or meeting; and, be it further
6969 RESOLVED, That the preceding clause be construed, for
7070 purposes of Section 551.046, Government Code, as a joint rule of the
7171 senate and house of representatives controlling the posting of
7272 notice for joint committees, and their subcommittees and advisory
7373 panels, in lieu of required posting with the secretary of state;
7474 and, be it further
7575 RESOLVED, That each joint committee have authority to issue
7676 process as provided in Sections 301.024-301.027, Government Code,
7777 provided that any motion for the issuance of process must receive
7878 the record vote of at least two-thirds of those present and voting,
7979 a quorum being present; and, be it further
8080 RESOLVED, That each joint committee be entitled to accept
8181 grants and donations as provided by Subsections (b) and (c),
8282 Section 301.032, Government Code, and that, on expiration of a
8383 joint committee, any unexpended funds remaining from a grant or
8484 donation be transferred in equal proportions to the accounts of the
8585 senate and house of representatives unless otherwise provided by
8686 the grantor or donor; and, be it further
8787 RESOLVED, That each joint committee, except as modified by or
8888 pursuant to this resolution, have all other powers and duties
8989 provided to special committees by Subchapter B, Chapter 301,
9090 Government Code, and the senate and house rules of procedure; and,
9191 be it further
9292 RESOLVED, That the operating accounts for each joint
9393 committee created pursuant to this resolution and any grants and
9494 donations that such committee may receive be administered by the
9595 Administration Division of the Texas Legislative Council; and, be
9696 it further
9797 RESOLVED, That the Texas Legislative Council Administration
9898 Division prepare, under the guidance of the presiding officers, a
9999 manual of procedures for joint committees and other entities
100100 created by the legislature for which funds are to be administered by
101101 the Texas Legislative Council establishing requirements as to
102102 printing needs, accounting procedures, ultimate disposition of
103103 records, and other administrative and financial matters; and, be it
104104 further
105105 RESOLVED, That citizen members appointed by the lieutenant
106106 governor or speaker of the house of representatives to joint
107107 committees created pursuant to this resolution be reimbursed from
108108 funds appropriated to the Texas Legislative Council for expenses of
109109 transportation, meals, lodging, and incidentals for travel on
110110 official committee business, at rates established by the joint
111111 chairs of the Texas Legislative Council consistent with provisions
112112 of the General Appropriations Act; and, be it further
113113 RESOLVED, That citizen members appointed by the governor to
114114 joint committees created pursuant to this resolution be reimbursed
115115 from funds appropriated to the office of the governor for expenses
116116 of travel on official committee business, at rates established by
117117 the joint chairs of the Texas Legislative Council consistent with
118118 provisions of the General Appropriations Act; and, be it further
119119 RESOLVED, That citizen members appointed by the lieutenant
120120 governor to senate select committees and citizen members appointed
121121 by the speaker of the house of representatives to house committees
122122 expanded or created under House Rule 4, Sections 24, 57, and 58,
123123 when engaged in travel on official committee business, be
124124 reimbursed for (1) transportation expenses at the same rates as
125125 authorized for state employees by the General Appropriations Act,
126126 and (2) actual expenses for meals, lodging, and incidentals,
127127 subject to any maximum reimbursement limitations for meals and
128128 lodging set by the Senate Administration Committee for senate
129129 select committees and by the Committee on House Administration for
130130 house select committees; and, be it further
131131 RESOLVED, That the Texas Legislative Council be authorized to
132132 reimburse the senate and house of representatives for expenses
133133 incurred by members of the senate and house for transportation,
134134 meals, lodging, and incidentals for travel on official business of
135135 joint committees created pursuant to this resolution; and, be it
136136 further
137137 RESOLVED, That the final report of each joint committee be
138138 approved by a majority of the voting membership of the committee;
139139 dissenting voting members may attach statements to the final report
140140 subject to any limitations specified in the rules adopted by the
141141 committee; and, be it further
142142 RESOLVED, That each joint committee created pursuant to this
143143 resolution expire on January 11, 2011, or an earlier date specified
144144 in the proclamation creating the committee.
