6 | 6 | | WHEREAS, The Texas Legislature for each of the last 13 |
---|
7 | 7 | | regular sessions has adopted a concurrent resolution authorizing |
---|
8 | 8 | | the creation and appointment of joint interim legislative study |
---|
9 | 9 | | committees by the lieutenant governor and speaker of the house of |
---|
10 | 10 | | representatives; and |
---|
11 | 11 | | WHEREAS, Renewal of the prior authorizations to the presiding |
---|
12 | 12 | | officers enables the legislature to address and study issues that |
---|
13 | 13 | | remain unresolved on sine die adjournment or that emerge subsequent |
---|
14 | 14 | | to that time; and |
---|
15 | 15 | | WHEREAS, It is also desirable to adopt by resolution various |
---|
16 | 16 | | rules and policies regarding the operation of joint committees to |
---|
17 | 17 | | supplement, and reconcile differences between, the senate and house |
---|
18 | 18 | | rules of procedure; now, therefore, be it |
---|
19 | 19 | | RESOLVED, That the 81st Legislature of the State of Texas |
---|
20 | 20 | | hereby authorize the lieutenant governor and speaker of the house |
---|
21 | 21 | | of representatives to create by mutual agreement such joint |
---|
22 | 22 | | committees as they consider necessary during the term of this |
---|
23 | 23 | | legislature; and, be it further |
---|
24 | 24 | | RESOLVED, That each joint committee created pursuant to this |
---|
25 | 25 | | resolution be composed of such combination of legislators, state |
---|
26 | 26 | | officials, or citizen members as shall be determined mutually by |
---|
27 | 27 | | the presiding officers of each house; and, be it further |
---|
28 | 28 | | RESOLVED, That on the request of the presiding officers, the |
---|
29 | 29 | | governor may appoint members to a joint committee created pursuant |
---|
30 | 30 | | to this resolution; and, be it further |
---|
31 | 31 | | RESOLVED, That the presiding officers issue for each |
---|
32 | 32 | | committee so created a joint proclamation identifying the issue or |
---|
33 | 33 | | issues to be studied and listing the committee membership or |
---|
34 | 34 | | describing the committee composition and that the proclamation be |
---|
35 | 35 | | filed with the secretary of the senate and the chief clerk of the |
---|
36 | 36 | | house of representatives; and, be it further |
---|
37 | 37 | | RESOLVED, That the presiding officers designate jointly a |
---|
38 | 38 | | chair, or designate alternatively two co-chairs, from among the |
---|
39 | 39 | | committee membership; and, be it further |
---|
40 | 40 | | RESOLVED, That the chair or co-chairs, acting jointly and |
---|
41 | 41 | | within four weeks of the proclamation, prepare and present to the |
---|
42 | 42 | | presiding officers a proposal for budget and staffing; and, be it |
---|
43 | 43 | | further |
---|
44 | 44 | | RESOLVED, That the chair or co-chairs be directed to use to |
---|
45 | 45 | | the greatest extent possible the existing staff and administrative |
---|
46 | 46 | | resources of committee members, standing committees, officers of |
---|
47 | 47 | | the senate and house, and legislative service agencies; and, be it |
---|
48 | 48 | | further |
---|
49 | 49 | | RESOLVED, That the presiding officers jointly review each |
---|
50 | 50 | | budget and staffing proposal, adopt budgetary and staffing |
---|
51 | 51 | | allocations, and determine the manner in which each joint committee |
---|
52 | 52 | | is to be funded; and, be it further |
---|
53 | 53 | | RESOLVED, That the joint committee chair, or the co-chairs |
---|
54 | 54 | | acting by mutual agreement, have authority to create and appoint |
---|
55 | 55 | | subcommittees or affiliated advisory panels and to designate |
---|
56 | 56 | | respective chairs for each, contingent on the advance approval of |
---|
57 | 57 | | the presiding officers for the creation and appointment of |
---|
58 | 58 | | subcommittees or advisory panels containing membership external to |
---|
59 | 59 | | the committee; and, be it further |
---|
60 | 60 | | RESOLVED, That each joint committee, and its subcommittees |
---|
61 | 61 | | and advisory panels, convene at the call of its chair or co-chairs; |
---|
62 | 62 | | provided that no joint committee, nor its subcommittees or advisory |
---|
63 | 63 | | panels, shall convene in a public hearing or other meeting for the |
---|
64 | 64 | | transaction of business unless public notice has been posted by its |
---|
65 | 65 | | chair or co-chairs at the locations specified by the senate and |
---|
66 | 66 | | house rules of procedure for posting of notice of standing |
---|
67 | 67 | | committee meetings at least five calendar days in advance of the |
---|
68 | 68 | | hearing or meeting; and, be it further |
---|
69 | 69 | | RESOLVED, That the preceding clause be construed, for |
---|
70 | 70 | | purposes of Section 551.046, Government Code, as a joint rule of the |
---|
71 | 71 | | senate and house of representatives controlling the posting of |
---|
72 | 72 | | notice for joint committees, and their subcommittees and advisory |
---|
73 | 73 | | panels, in lieu of required posting with the secretary of state; |
---|
74 | 74 | | and, be it further |
---|
75 | 75 | | RESOLVED, That each joint committee have authority to issue |
---|
76 | 76 | | process as provided in Sections 301.024-301.027, Government Code, |
---|
77 | 77 | | provided that any motion for the issuance of process must receive |
---|
78 | 78 | | the record vote of at least two-thirds of those present and voting, |
---|
79 | 79 | | a quorum being present; and, be it further |
---|
80 | 80 | | RESOLVED, That each joint committee be entitled to accept |
---|
81 | 81 | | grants and donations as provided by Subsections (b) and (c), |
---|
82 | 82 | | Section 301.032, Government Code, and that, on expiration of a |
---|
83 | 83 | | joint committee, any unexpended funds remaining from a grant or |
---|
84 | 84 | | donation be transferred in equal proportions to the accounts of the |
---|
85 | 85 | | senate and house of representatives unless otherwise provided by |
---|
86 | 86 | | the grantor or donor; and, be it further |
---|
87 | 87 | | RESOLVED, That each joint committee, except as modified by or |
---|
88 | 88 | | pursuant to this resolution, have all other powers and duties |
---|
89 | 89 | | provided to special committees by Subchapter B, Chapter 301, |
---|
90 | 90 | | Government Code, and the senate and house rules of procedure; and, |
---|
91 | 91 | | be it further |
---|
92 | 92 | | RESOLVED, That the operating accounts for each joint |
---|
93 | 93 | | committee created pursuant to this resolution and any grants and |
---|
94 | 94 | | donations that such committee may receive be administered by the |
---|
95 | 95 | | Administration Division of the Texas Legislative Council; and, be |
---|
96 | 96 | | it further |
---|
97 | 97 | | RESOLVED, That the Texas Legislative Council Administration |
---|
98 | 98 | | Division prepare, under the guidance of the presiding officers, a |
---|
99 | 99 | | manual of procedures for joint committees and other entities |
---|
100 | 100 | | created by the legislature for which funds are to be administered by |
---|
101 | 101 | | the Texas Legislative Council establishing requirements as to |
---|
102 | 102 | | printing needs, accounting procedures, ultimate disposition of |
---|
103 | 103 | | records, and other administrative and financial matters; and, be it |
---|
104 | 104 | | further |
---|
105 | 105 | | RESOLVED, That citizen members appointed by the lieutenant |
---|
106 | 106 | | governor or speaker of the house of representatives to joint |
---|
107 | 107 | | committees created pursuant to this resolution be reimbursed from |
---|
108 | 108 | | funds appropriated to the Texas Legislative Council for expenses of |
---|
109 | 109 | | transportation, meals, lodging, and incidentals for travel on |
---|
110 | 110 | | official committee business, at rates established by the joint |
---|
111 | 111 | | chairs of the Texas Legislative Council consistent with provisions |
---|
112 | 112 | | of the General Appropriations Act; and, be it further |
---|
113 | 113 | | RESOLVED, That citizen members appointed by the governor to |
---|
114 | 114 | | joint committees created pursuant to this resolution be reimbursed |
---|
115 | 115 | | from funds appropriated to the office of the governor for expenses |
---|
116 | 116 | | of travel on official committee business, at rates established by |
---|
117 | 117 | | the joint chairs of the Texas Legislative Council consistent with |
---|
118 | 118 | | provisions of the General Appropriations Act; and, be it further |
---|
119 | 119 | | RESOLVED, That citizen members appointed by the lieutenant |
---|
120 | 120 | | governor to senate select committees and citizen members appointed |
---|
121 | 121 | | by the speaker of the house of representatives to house committees |
---|
122 | 122 | | expanded or created under House Rule 4, Sections 24, 57, and 58, |
---|
123 | 123 | | when engaged in travel on official committee business, be |
---|
124 | 124 | | reimbursed for (1) transportation expenses at the same rates as |
---|
125 | 125 | | authorized for state employees by the General Appropriations Act, |
---|
126 | 126 | | and (2) actual expenses for meals, lodging, and incidentals, |
---|
127 | 127 | | subject to any maximum reimbursement limitations for meals and |
---|
128 | 128 | | lodging set by the Senate Administration Committee for senate |
---|
129 | 129 | | select committees and by the Committee on House Administration for |
---|
130 | 130 | | house select committees; and, be it further |
---|
131 | 131 | | RESOLVED, That the Texas Legislative Council be authorized to |
---|
132 | 132 | | reimburse the senate and house of representatives for expenses |
---|
133 | 133 | | incurred by members of the senate and house for transportation, |
---|
134 | 134 | | meals, lodging, and incidentals for travel on official business of |
---|
135 | 135 | | joint committees created pursuant to this resolution; and, be it |
---|
136 | 136 | | further |

137 | 137 | | RESOLVED, That the final report of each joint committee be |
---|
138 | 138 | | approved by a majority of the voting membership of the committee; |
---|
139 | 139 | | dissenting voting members may attach statements to the final report |
---|
140 | 140 | | subject to any limitations specified in the rules adopted by the |
---|
141 | 141 | | committee; and, be it further |
---|
142 | 142 | | RESOLVED, That each joint committee created pursuant to this |
---|
143 | 143 | | resolution expire on January 11, 2011, or an earlier date specified |
---|
144 | 144 | | in the proclamation creating the committee. |
