| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 11 | 11 | | adding Section 52k to read as follows: |
|---|
| 12 | 12 | | Sec. 52k. The legislature by general law may authorize a |
|---|
| 13 | 13 | | municipality or county to issue bonds or notes to finance the |
|---|
| 14 | 14 | | acquisition of buffer areas or open spaces adjacent to a military |
|---|
| 15 | 15 | | installation for the prevention of encroachment or for the |
|---|
| 16 | 16 | | construction of roadways, utilities, or other infrastructure to |
|---|
| 17 | 17 | | protect or promote the mission of the military installation. The |
|---|
| 18 | 18 | | municipality or county may pledge increases in ad valorem tax |
|---|
| 19 | 19 | | revenues imposed in the area by the municipality, county, or other |
|---|
| 20 | 20 | | political subdivisions for repayment of the bonds or notes. |
|---|
| 21 | 21 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 22 | 22 | | submitted to the voters at an election to be held November 3, 2009. |

| 23 | 23 | | The ballot shall be printed to permit voting for or against the |
|---|
| 24 | 24 | | proposition: "The constitutional amendment authorizing the |
|---|
| 25 | 25 | | financing, including through tax increment financing, of the |
|---|
| 26 | 26 | | acquisition by municipalities and counties of buffer areas or open |
|---|
| 27 | 27 | | spaces adjacent to a military installation for the prevention of |
|---|
| 28 | 28 | | encroachment or for the construction of roadways, utilities, or |
|---|
| 29 | 29 | | other infrastructure to protect or promote the mission of the |
|---|
| 30 | 30 | | military installation." |
