99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article III, Texas Constitution, is amended by
1111 adding Section 52k to read as follows:
1212 Sec. 52k. The legislature by general law may authorize a
1313 municipality or county to issue bonds or notes to finance the
1414 acquisition of buffer areas or open spaces adjacent to a military
1515 installation for the prevention of encroachment or for the
1616 construction of roadways, utilities, or other infrastructure to
1717 protect or promote the mission of the military installation. The
1818 municipality or county may pledge increases in ad valorem tax
1919 revenues imposed in the area by the municipality, county, or other
2020 political subdivisions for repayment of the bonds or notes.
2121 SECTION 2. This proposed constitutional amendment shall be
2222 submitted to the voters at an election to be held November 3, 2009.
2323 The ballot shall be printed to permit voting for or against the
2424 proposition: "The constitutional amendment authorizing the
2525 financing, including through tax increment financing, of the
2626 acquisition by municipalities and counties of buffer areas or open
2727 spaces adjacent to a military installation for the prevention of
2828 encroachment or for the construction of roadways, utilities, or
2929 other infrastructure to protect or promote the mission of the
3030 military installation."
