7 | 7 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Article III, Texas Constitution, is amended by | |
9 | 9 | adding Section 7-a to read as follows: | |
10 | 10 | Sec. 7-a. DISQUALIFICATION OF CERTAIN PERSONS FROM SERVICE | |
11 | 11 | IN THE LEGISLATURE. No person shall be a member of either House if | |
12 | 12 | the person has been finally convicted of a felony, regardless of | |
13 | 13 | whether the person has fully discharged the person's sentence, | |
14 | 14 | including any term of incarceration, parole, or supervision, or | |
15 | 15 | completed a period of probation ordered by any court or has been | |
16 | 16 | pardoned or otherwise released from the resulting disability to | |
17 | 17 | vote. | |
18 | 18 | SECTION 2. This proposed constitutional amendment shall be | |
19 | 19 | submitted to the voters at an election to be held November 3, 2009. | |
20 | 20 | The ballot shall be printed to permit voting for or against the | |
21 | 21 | proposition: "The constitutional amendment disqualifying persons | |
22 | 22 | who have been finally convicted of a felony from service in the | |
23 | 23 | Legislature." |
