88 A JOINT RESOLUTION
99 proposing a constitutional amendment to provide that the Railroad
1010 Commission of Texas is governed by a single elected railroad
1111 commissioner.
1212 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subsection (b), Section 30, Article XVI, Texas
1414 Constitution, is amended to read as follows:
1515 (b) When a Railroad Commission is created by law it shall be
1616 governed by a single railroad commissioner [composed of three
1717 Commissioners] who shall be elected by the people at a general
1818 election for State officers, and whose term [their terms] of office
1919 shall be four [six] years. [And one Railroad Commissioner shall be
2020 elected every two years.] In case of vacancy in said office the
2121 Governor of the State shall fill said vacancy by appointment until
2222 the next general election.
2323 SECTION 2. The following temporary provision is added to
2424 the Texas Constitution:
2525 TEMPORARY PROVISION. (a) This temporary provision applies
2626 to the constitutional amendment proposed by the 81st Legislature,
2727 Regular Session, 2009, providing that the Railroad Commission of
2828 Texas will be governed by a single railroad commissioner instead of
2929 by a three-member commission.
3030 (b) The first railroad commissioner elected under the
3131 amendment shall be elected at the general election held in November
3232 2012 to serve for a term that begins January 1, 2013.
3333 (c) Until the first railroad commissioner elected under the
3434 amendment takes office, the members of the Railroad Commission of
3535 Texas serving on the date that the adoption of the amendment by the
3636 voters is shown by the official canvass of returns shall, unless
3737 otherwise removed as provided by law, continue in office under the
3838 prior law that governed the composition of the Railroad Commission
3939 of Texas, and that prior law is continued in effect for that
4040 purpose. If on January 1, 2013, there is a vacancy in the new office
4141 of railroad commissioner created under the amendment because the
4242 first railroad commissioner-elect has died or refuses or is
4343 permanently unable to serve, the members of the Railroad Commission
4444 of Texas serving on the date that the adoption of the amendment by
4545 the voters is shown by the official canvass of returns shall, unless
4646 otherwise removed as provided by law, continue in office under the
4747 prior law that governed the composition of the Railroad Commission
4848 of Texas until the governor fills the vacancy by appointment in the
4949 manner provided by law. The prior law that governed the composition
5050 of the Railroad Commission of Texas is continued in effect for that
5151 purpose. At the time that the first railroad commissioner elected,
5252 or in extraordinary circumstances appointed, under the amendment
5353 takes office, the three-member governing body of the Railroad
5454 Commission of Texas is abolished.
5555 (d) The railroad commissioner succeeds to all powers,
5656 duties, rights, and obligations of the three-member governing body
5757 of the Railroad Commission of Texas, and the abolition of the
5858 three-member governing body of the commission does not affect the
5959 validity of any right, duty, decision, rule, or action of any kind
6060 taken by or under the authority of the three-member governing body.
6161 (e) This temporary provision expires January 1, 2014.
6262 SECTION 3. This proposed constitutional amendment shall be
6363 submitted to the voters at an election to be held November 3, 2009.
6464 The ballot shall be printed to permit voting for or against the
6565 proposition: "The constitutional amendment to provide that the
6666 Railroad Commission of Texas will be governed by a single elected
6767 railroad commissioner instead of by an elected three-member
6868 commission."
