44 A JOINT RESOLUTION
55 proposing a constitutional amendment authorizing the legislature
66 to permit conservation and reclamation districts in Hays and
77 Chambers Counties to issue bonds supported by ad valorem taxes to
88 fund the development and maintenance of parks and recreational
99 facilities.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 59(c-1), Article XVI, Texas
1212 Constitution, is amended to read as follows:
1313 (c-1) In addition and only as provided by this subsection,
1414 the Legislature may authorize conservation and reclamation
1515 districts to develop and finance with taxes those types and
1616 categories of parks and recreational facilities that were not
1717 authorized by this section to be developed and financed with taxes
1818 before September 13, 2003. For development of such parks and
1919 recreational facilities, the Legislature may authorize
2020 indebtedness payable from taxes as may be necessary to provide for
2121 improvements and maintenance only for a conservation and
2222 reclamation district all or part of which is located in Bexar
2323 County, Bastrop County, Waller County, Hays County, Travis County,
2424 Williamson County, Harris County, Galveston County, Chambers
2525 County, Brazoria County, Fort Bend County, or Montgomery County, or
2626 for the Tarrant Regional Water District, a water control and
2727 improvement district located in whole or in part in Tarrant County.
2828 All the indebtedness may be evidenced by bonds of the conservation
2929 and reclamation district, to be issued under regulations as may be
3030 prescribed by law. The Legislature may also authorize the levy and
3131 collection within such district of all taxes, equitably
3232 distributed, as may be necessary for the payment of the interest and
3333 the creation of a sinking fund for the payment of the bonds and for
3434 maintenance of and improvements to such parks and recreational
3535 facilities. The indebtedness shall be a lien on the property
3636 assessed for the payment of the bonds. The Legislature may not
3737 authorize the issuance of bonds or provide for indebtedness under
3838 this subsection against a conservation and reclamation district
3939 unless a proposition is first submitted to the qualified voters of
4040 the district and the proposition is adopted. This subsection
4141 expands the authority of the Legislature with respect to certain
4242 conservation and reclamation districts and is not a limitation on
4343 the authority of the Legislature with respect to conservation and
4444 reclamation districts and parks and recreational facilities
4545 pursuant to this section as that authority existed before September
4646 13, 2003.
4747 SECTION 2. The legislature intends by the amendment
4848 proposed by Section 1 of this resolution to expand the authority of
4949 the legislature with regard to conservation and reclamation
5050 districts in Hays and Chambers Counties. The proposed amendment
5151 should not be construed as a limitation on the powers of the
5252 legislature or of a district with respect to parks and recreational
5353 facilities as those powers exist immediately before the amendment
5454 takes effect.
5555 SECTION 3. This proposed constitutional amendment shall be
5656 submitted to the voters at an election to be held November 3, 2009.
5757 The ballot shall be printed to permit voting for or against the
5858 proposition: "The constitutional amendment authorizing the
5959 legislature to permit conservation and reclamation districts in
6060 Hays and Chambers Counties to issue bonds supported by ad valorem
6161 taxes to fund the development and maintenance of parks and
6262 recreational facilities."
