| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter J, Chapter 21, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 21.461 to read as follows: |
|---|
| 13 | 13 | | Sec. 21.461. PROFESSIONAL DEVELOPMENT INSTITUTES REGARDING |
|---|
| 14 | 14 | | EDUCATION OF STUDENTS WITH DISABILITIES. (a) The commissioner |
|---|
| 15 | 15 | | shall develop and make available professional development |
|---|
| 16 | 16 | | institutes for teachers and paraprofessionals relating to |
|---|
| 17 | 17 | | research-based instructional services for students with |
|---|
| 18 | 18 | | disabilities, including autism spectrum disorders. |
|---|
| 19 | 19 | | (b) A professional development institute developed under |
|---|
| 20 | 20 | | this section must address: |
|---|
| 21 | 21 | | (1) disability-specific information necessary to |
|---|
| 22 | 22 | | enable a teacher or paraprofessional to work effectively in the |
|---|
| 23 | 23 | | classroom with students with disabilities; |
|---|
| 24 | 24 | | (2) instructional techniques proven by scientifically |
|---|
| 25 | 25 | | based research to be effective in teaching the curriculum required |
|---|
| 26 | 26 | | under Section 28.002 to students with disabilities; and |
|---|
| 27 | 27 | | (3) appropriate management of behaviors related to a |
|---|
| 28 | 28 | | student's disability that may affect the student's performance. |
|---|
| 29 | 29 | | (c) The commissioner shall adopt criteria for selection of |
|---|
| 30 | 30 | | teachers and paraprofessionals authorized to attend a professional |
|---|
| 31 | 31 | | development institute developed under this section. The |
|---|
| 32 | 32 | | commissioner must give priority to teachers and paraprofessionals |
|---|
| 33 | 33 | | who have a significant level of professional contact with students |
|---|
| 34 | 34 | | with autism spectrum disorders. |
|---|
| 35 | 35 | | (d) From funds appropriated for the purpose, the |
|---|
| 36 | 36 | | commissioner shall pay a stipend to each teacher or |
|---|
| 37 | 37 | | paraprofessional who completes a professional development |
|---|
| 38 | 38 | | institute developed under this section. The commissioner shall |
|---|
| 39 | 39 | | determine the amount of the stipend paid under this subsection. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2009. |
