99 AN ACT
1010 relating to posttrial psychological counseling for jurors in a
1111 criminal trial or juvenile adjudication hearing involving graphic
1212 evidence or testimony.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subsection (f), Article 56.04, Code of Criminal
1515 Procedure, is amended to read as follows:
1616 (f) The commissioners court may approve a program in which
1717 the crime victim liaison or victim assistance coordinator may offer
1818 not more than 10 hours of posttrial psychological counseling for a
1919 person who serves as a juror or an alternate juror in a criminal
2020 [the] trial [of an offense under Section 19.02, 19.03, 21.11,
2121 22.011, 22.021, 43.05, 43.25, or 43.251, Penal Code,] involving
2222 graphic evidence or testimony and who requests the posttrial
2323 psychological counseling not later than the 180th day after the
2424 date on which the jury in the trial is dismissed. The crime victim
2525 liaison or victim assistance coordinator may provide the counseling
2626 using a provider that assists local criminal justice agencies in
2727 providing similar services to victims.
2828 SECTION 2. The heading to Section 57.003, Family Code, is
2929 amended to read as follows:
3030 Sec. 57.003. DUTIES [DUTY] OF JUVENILE BOARD AND VICTIM
3131 ASSISTANCE COORDINATOR.
3232 SECTION 3. Section 57.003, Family Code, is amended by
3333 adding Subsection (g) to read as follows:
3434 (g) The juvenile board may approve a program in which the
3535 victim assistance coordinator may offer not more than 10 hours of
3636 posttrial psychological counseling for a person who serves as a
3737 juror or an alternate juror in an adjudication hearing involving
3838 graphic evidence or testimony and who requests the posttrial
3939 psychological counseling not later than the 180th day after the
4040 date on which the jury in the adjudication hearing is dismissed.
4141 The victim assistance coordinator may provide the counseling using
4242 a provider that assists local juvenile justice agencies in
4343 providing similar services to victims.
4444 SECTION 4. The change in law made by this Act applies only
4545 to a criminal trial or juvenile adjudication hearing for which a
4646 jury is selected on or after the effective date of this Act. A
4747 criminal trial or juvenile adjudication hearing for which a jury is
4848 selected before the effective date of this Act is governed by the
4949 law as it existed immediately before that date, and that law is
5050 continued in effect for that purpose.
5151 SECTION 5. This Act takes effect September 1, 2009.
