5	5	relating to the requirement to keep records of game bird or animal
6	6	carcasses placed in a cold storage or processing facility.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subdivision (8), Section 42.001, Parks and
9	9	Wildlife Code, is amended to read as follows:
10	10	(8) "Quartering" means the processing of an animal
11	11	into not more than two hindquarters each having the leg bone (femur)
12	12	attached down to the knee [hock] and two front shoulders
13	13	[forequarters] each having the leg bones (scapula and humerus)
14	14	[portion to the knee] attached down to the elbow [shoulder blade].
15	15	The term also includes removal of two back straps [and trimmings
16	16	from the neck and rib cage].
17	17	SECTION 2. Section 62.029, Parks and Wildlife Code, is
18	18	amended by amending Subsections (a) and (f) and adding Subsection
19	19	(g) to read as follows:
20	20	(a) In [As used in] this section:
21	21	(1) "Carcass" has the meaning assigned by Section
22	22	42.001.
23	23	(2) "Cold[, "cold] storage or processing facility" has
24	24	the meaning assigned by Section 42.001.
25	25	(3) "Hunting lease" has the meaning assigned by
26	26	Section 43.041.
27	27	(4) "Private cold storage or processing facility"
28	28	means a cold storage or processing facility that is not available
29	29	for use by the public.
30	30	(5) "Quartering" has the meaning assigned by Section
31	31	42.001.
32	32	(f) This section does not apply to a private, noncommercial,
33	33	family-owned cold storage or processing facility unless the
34	34	facility is located on a hunting lease and is made available to
35	35	individuals other than the landowner, the landowner's nonpaying
36	36	family members, or the landowner's nonpaying guests.
37	37	(g) This section does not require the entry or maintenance
38	38	of a record for the carcass of a deer or antelope that is properly
39	39	tagged and is placed in a private cold storage or processing
40	40	facility.
41	41	SECTION 3. The change in law made by this Act applies only
42	42	to an offense committed on or after the effective date of this Act.
43	43	An offense committed before the effective date of this Act is
44	44	covered by the law in effect when the offense was committed, and the
45	45	former law is continued in effect for that purpose. For purposes of
46	46	this section, an offense was committed before the effective date of
47	47	this Act if any element of the offense occurred before that date.
48	48	SECTION 4. This Act takes effect September 1, 2009.
