66 relating to regional poison control centers.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 777.001, Health and Safety Code, is
99 amended to read as follows:
1010 Sec. 777.001. REGIONAL POISON CONTROL CENTERS. (a) Six
1111 regional centers for poison control are designated as the regional
1212 poison control centers for the state as follows:
1313 (1) The University of Texas Medical Branch at
1414 Galveston;
1515 (2) the Dallas County Hospital District/North Texas
1616 Poison Center;
1717 (3) The University of Texas Health Science Center at
1818 San Antonio;
1919 (4) R. E. Thomason General Hospital, El Paso County
2020 Hospital District;
2121 (5) [Northwest] Texas Tech University Health Sciences
2222 Center [Hospital, Amarillo Hospital District]; and
2323 (6) Scott and White Memorial Hospital, Temple, Texas.
2424 (b) The poison control centers shall coordinate poison
2525 control activities within the designated health and human services
2626 regions for the state. The [Texas] Department of State Health
2727 Services and the [Advisory] Commission on State Emergency
2828 Communications shall jointly adopt rules designating the region for
2929 each poison control center. The [Texas] Department of State Health
3030 Services and the [Advisory] Commission on State Emergency
3131 Communications may jointly adopt rules permitting poison control
3232 centers to provide services for regions served by other poison
3333 control centers in this state as necessary to maximize efficient
3434 use of resources and provide appropriate services in each region.
3535 (c) The executive commissioner of the [Texas Board of]
3636 Health and Human Services Commission may [vote to] designate a
3737 seventh regional or satellite poison control center in Harris
3838 County. That poison control center is subject to all provisions of
3939 this chapter and other law relating to regional poison control
4040 centers.
4141 SECTION 2. Section 777.006, Health and Safety Code, is
4242 amended to read as follows:
4343 Sec. 777.006. INFORMATION AT BIRTH. The [Texas] Department
4444 of State Health Services shall assist the regional poison control
4545 centers in providing informational packets on poison prevention to
4646 parents of newborns.
4747 SECTION 3. Sections 777.008 and 777.009, Health and Safety
4848 Code, are amended to read as follows:
4949 Sec. 777.008. COORDINATING COMMITTEE. (a) The
5050 coordinating committee on poison control shall advise the
5151 Department [Texas Board] of State Health Services and the
5252 [Advisory] Commission on State Emergency Communications.
5353 (b) The committee is composed of one public member appointed
5454 by the executive commissioner [Texas Board] of the Health and Human
5555 Services Commission, one public member appointed by the [Advisory]
5656 Commission on State Emergency Communications, and eight [13]
5757 members appointed by the chief executive officer of each of the
5858 following entities:
5959 (1) The University of Texas Medical Branch at
6060 Galveston;
6161 (2) the Dallas County Hospital District/North Texas
6262 Poison Center;
6363 (3) The University of Texas Health Science Center at
6464 San Antonio;
6565 (4) R. E. Thomason General Hospital, El Paso County
6666 Hospital District;
6767 (5) [Northwest Texas Hospital, Amarillo Hospital
6868 District;
6969 [(6)] Scott and White Memorial Hospital, Temple,
7070 Texas;
7171 (6) [(7) The University of Texas Southwestern
7272 Medical Center at Dallas;
7373 [(8) The Texas A&M University Health Science Center;
7474 [(9)] the Texas Tech University Health Sciences
7575 Center;
7676 (7) [(10) the Texas Veterinary Medical Diagnostic
7777 Laboratory;
7878 [(11) the Department of Agriculture;
7979 [(12)] the [Texas] Department of State Health
8080 Services; and
8181 (8) [(13)] the [Advisory] Commission on State
8282 Emergency Communications.
8383 Sec. 777.009. FUNDING. (a) The [Texas] Department of
8484 State Health Services and the [Advisory] Commission on State
8585 Emergency Communications shall establish a program to award grants
8686 to fund the regional poison control centers.
8787 (b) The executive commissioner of the Health and Human
8888 Services Commission on behalf of the Department [Texas Board] of
8989 State Health Services and the [Advisory] Commission on State
9090 Emergency Communications shall jointly adopt rules to establish
9191 criteria for awarding the grants. The rules must require the
9292 agencies to consider:
9393 (1) the need of the region based on population served
9494 for poison control services and the extent to which the grant would
9595 meet the identified need;
9696 (2) the assurance of providing quality services;
9797 (3) the availability of other funding sources;
9898 (4) achieving or maintaining certification as a poison
9999 control center with the American Association of Poison Control
100100 Centers;
101101 (5) maintenance of effort; and
102102 (6) the development or existence of
103103 telecommunications systems.
104104 (c) The [Texas] Department of State Health Services and the
105105 [Advisory] Commission on State Emergency Communications may
106106 approve grants according to the [their] jointly adopted rules. A
107107 grant awarded under this section is governed by Chapter 783,
108108 Government Code, and the rules adopted under that chapter.
109109 (d) The [Texas] Department of State Health Services and the
110110 [Advisory] Commission on State Emergency Communications may accept
111111 gifts or grants from any source for purposes of this chapter.
112112 SECTION 4. Subsections (a) and (b), Section 777.010, Health
113113 and Safety Code, are amended to read as follows:
114114 (a) On approval by and in coordination with the governor,
115115 the [Texas] Department of State Health Services and the [Advisory]
116116 Commission on State Emergency Communications may jointly enter into
117117 a contract for the provision of telephone referral and information
118118 services or any program or service described by Section 777.003 to
119119 any person, including:
120120 (1) another state or a political subdivision of
121121 another state; and
122122 (2) another country or a political subdivision of
123123 another country.
124124 (b) The [Texas] Department of State Health Services and the
125125 [Advisory] Commission on State Emergency Communications shall
126126 contract with one or more regional poison control centers to
127127 provide the services required under a contract entered into under
128128 Subsection (a). The department and the commission may not enter
129129 into a contract under this subsection if, in the opinion of the
130130 department and the commission, the regional poison control center's
131131 performance of the contract would result in a diminishment in the
132132 services provided in the region.
133133 SECTION 5. Section 777.011, Health and Safety Code, is
134134 repealed.
135135 SECTION 6. This Act takes effect September 1, 2009.
