7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Section 777.001, Health and Safety Code, is |
---|
9 | 9 | | amended to read as follows: |
---|
10 | 10 | | Sec. 777.001. REGIONAL POISON CONTROL CENTERS. (a) Six |
---|
11 | 11 | | regional centers for poison control are designated as the regional |
---|
12 | 12 | | poison control centers for the state as follows: |
---|
13 | 13 | | (1) The University of Texas Medical Branch at |
---|
14 | 14 | | Galveston; |
---|
15 | 15 | | (2) the Dallas County Hospital District/North Texas |
---|
16 | 16 | | Poison Center; |
---|
17 | 17 | | (3) The University of Texas Health Science Center at |
---|
18 | 18 | | San Antonio; |
---|
19 | 19 | | (4) R. E. Thomason General Hospital, El Paso County |
---|
20 | 20 | | Hospital District; |
---|
21 | 21 | | (5) [Northwest] Texas Tech University Health Sciences |
---|
22 | 22 | | Center [Hospital, Amarillo Hospital District]; and |
---|
23 | 23 | | (6) Scott and White Memorial Hospital, Temple, Texas. |
---|
24 | 24 | | (b) The poison control centers shall coordinate poison |
---|
25 | 25 | | control activities within the designated health and human services |
---|
26 | 26 | | regions for the state. The [Texas] Department of State Health |
---|
27 | 27 | | Services and the [Advisory] Commission on State Emergency |
---|
28 | 28 | | Communications shall jointly adopt rules designating the region for |
---|
29 | 29 | | each poison control center. The [Texas] Department of State Health |
---|
30 | 30 | | Services and the [Advisory] Commission on State Emergency |
---|
31 | 31 | | Communications may jointly adopt rules permitting poison control |
---|
32 | 32 | | centers to provide services for regions served by other poison |
---|
33 | 33 | | control centers in this state as necessary to maximize efficient |
---|
34 | 34 | | use of resources and provide appropriate services in each region. |
---|
35 | 35 | | (c) The executive commissioner of the [Texas Board of] |
---|
36 | 36 | | Health and Human Services Commission may [vote to] designate a |
---|
37 | 37 | | seventh regional or satellite poison control center in Harris |
---|
38 | 38 | | County. That poison control center is subject to all provisions of |
---|
39 | 39 | | this chapter and other law relating to regional poison control |
---|
40 | 40 | | centers. |
---|
41 | 41 | | SECTION 2. Section 777.006, Health and Safety Code, is |
---|
42 | 42 | | amended to read as follows: |
---|
43 | 43 | | Sec. 777.006. INFORMATION AT BIRTH. The [Texas] Department |
---|
44 | 44 | | of State Health Services shall assist the regional poison control |
---|
45 | 45 | | centers in providing informational packets on poison prevention to |
---|
46 | 46 | | parents of newborns. |
---|
47 | 47 | | SECTION 3. Sections 777.008 and 777.009, Health and Safety |
---|
48 | 48 | | Code, are amended to read as follows: |
---|
49 | 49 | | Sec. 777.008. COORDINATING COMMITTEE. (a) The |
---|
50 | 50 | | coordinating committee on poison control shall advise the |
---|
51 | 51 | | Department [Texas Board] of State Health Services and the |
---|
52 | 52 | | [Advisory] Commission on State Emergency Communications. |
---|
53 | 53 | | (b) The committee is composed of one public member appointed |
---|
54 | 54 | | by the executive commissioner [Texas Board] of the Health and Human |
---|
55 | 55 | | Services Commission, one public member appointed by the [Advisory] |
---|
56 | 56 | | Commission on State Emergency Communications, and eight [13] |
---|
57 | 57 | | members appointed by the chief executive officer of each of the |
---|
58 | 58 | | following entities: |
---|
59 | 59 | | (1) The University of Texas Medical Branch at |
---|
60 | 60 | | Galveston; |
---|

83 | 83 | | Sec. 777.009. FUNDING. (a) The [Texas] Department of |
---|
84 | 84 | | State Health Services and the [Advisory] Commission on State |
---|
85 | 85 | | Emergency Communications shall establish a program to award grants |
---|
86 | 86 | | to fund the regional poison control centers. |
---|
87 | 87 | | (b) The executive commissioner of the Health and Human |
---|
88 | 88 | | Services Commission on behalf of the Department [Texas Board] of |
---|
89 | 89 | | State Health Services and the [Advisory] Commission on State |
---|
90 | 90 | | Emergency Communications shall jointly adopt rules to establish |
---|
91 | 91 | | criteria for awarding the grants. The rules must require the |
---|
92 | 92 | | agencies to consider: |
---|
93 | 93 | | (1) the need of the region based on population served |
---|
94 | 94 | | for poison control services and the extent to which the grant would |
---|
95 | 95 | | meet the identified need; |
---|
96 | 96 | | (2) the assurance of providing quality services; |
---|
97 | 97 | | (3) the availability of other funding sources; |
---|
98 | 98 | | (4) achieving or maintaining certification as a poison |
---|
99 | 99 | | control center with the American Association of Poison Control |
---|
100 | 100 | | Centers; |
---|
101 | 101 | | (5) maintenance of effort; and |
---|
102 | 102 | | (6) the development or existence of |
---|
103 | 103 | | telecommunications systems. |
---|
104 | 104 | | (c) The [Texas] Department of State Health Services and the |
---|
105 | 105 | | [Advisory] Commission on State Emergency Communications may |
---|
106 | 106 | | approve grants according to the [their] jointly adopted rules. A |
---|
107 | 107 | | grant awarded under this section is governed by Chapter 783, |
---|
108 | 108 | | Government Code, and the rules adopted under that chapter. |
---|
109 | 109 | | (d) The [Texas] Department of State Health Services and the |
---|
110 | 110 | | [Advisory] Commission on State Emergency Communications may accept |
---|
111 | 111 | | gifts or grants from any source for purposes of this chapter. |
---|
112 | 112 | | SECTION 4. Subsections (a) and (b), Section 777.010, Health |
---|
113 | 113 | | and Safety Code, are amended to read as follows: |
---|
114 | 114 | | (a) On approval by and in coordination with the governor, |
---|
115 | 115 | | the [Texas] Department of State Health Services and the [Advisory] |
---|
116 | 116 | | Commission on State Emergency Communications may jointly enter into |
---|
117 | 117 | | a contract for the provision of telephone referral and information |
---|
118 | 118 | | services or any program or service described by Section 777.003 to |
---|
119 | 119 | | any person, including: |
---|
120 | 120 | | (1) another state or a political subdivision of |
---|
121 | 121 | | another state; and |
---|
122 | 122 | | (2) another country or a political subdivision of |
---|
123 | 123 | | another country. |
---|
124 | 124 | | (b) The [Texas] Department of State Health Services and the |
---|
125 | 125 | | [Advisory] Commission on State Emergency Communications shall |
---|
126 | 126 | | contract with one or more regional poison control centers to |
---|
127 | 127 | | provide the services required under a contract entered into under |
---|
128 | 128 | | Subsection (a). The department and the commission may not enter |
---|
129 | 129 | | into a contract under this subsection if, in the opinion of the |
---|
130 | 130 | | department and the commission, the regional poison control center's |
---|
131 | 131 | | performance of the contract would result in a diminishment in the |
---|
132 | 132 | | services provided in the region. |
---|
133 | 133 | | SECTION 5. Section 777.011, Health and Safety Code, is |
---|
134 | 134 | | repealed. |
---|
135 | 135 | | SECTION 6. This Act takes effect September 1, 2009. |
