66 relating to the employment of certain persons by amusement parks.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. The heading to Chapter 2151, Occupations Code,
99 is amended to read as follows:
1010 CHAPTER 2151. REGULATION OF AMUSEMENT RIDES AND AMUSEMENT PARKS
1111 SECTION 2. Section 2151.002, Occupations Code, is amended
1212 by adding Subdivision (7) to read as follows:
1313 (7) "Amusement park" means a temporary or permanent indoor
1414 or outdoor facility or park where amusement rides are available for
1515 use by the public. The term does not include any public or private
1616 driveway, street, sidewalk or walkway, parking lot, parking garage,
1717 or other parking area.
1818 SECTION 3. Chapter 2151, Occupations Code, is amended by
1919 adding Subchapter E to read as follows:
2020 SUBCHAPTER E. AMUSEMENT PARK REGULATION
2121 Sec. 2151.201. PROHIBITED EMPLOYMENT OF PERSONS CONVICTED
2222 OF CERTAIN SEXUAL OFFENSES. An owner or operator of an amusement
2323 park may not employ in an amusement park a person who has been
2424 convicted of, entered a plea of nolo contendere or guilty to, or
2525 received deferred adjudication for a sexual offense as defined by
2626 Chapter 21, Penal Code.
2727 SECTION 4. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
