| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. The heading to Chapter 2151, Occupations Code, |
|---|
| 9 | 9 | | is amended to read as follows: |
|---|
| 10 | 10 | | CHAPTER 2151. REGULATION OF AMUSEMENT RIDES AND AMUSEMENT PARKS |
|---|
| 11 | 11 | | SECTION 2. Section 2151.002, Occupations Code, is amended |
|---|
| 12 | 12 | | by adding Subdivision (7) to read as follows: |
|---|
| 13 | 13 | | (7) "Amusement park" means a temporary or permanent indoor |
|---|
| 14 | 14 | | or outdoor facility or park where amusement rides are available for |
|---|
| 15 | 15 | | use by the public. The term does not include any public or private |
|---|
| 16 | 16 | | driveway, street, sidewalk or walkway, parking lot, parking garage, |
|---|
| 17 | 17 | | or other parking area. |

| 18 | 18 | | SECTION 3. Chapter 2151, Occupations Code, is amended by |
|---|
| 19 | 19 | | adding Subchapter E to read as follows: |

| 20 | 20 | | SUBCHAPTER E. AMUSEMENT PARK REGULATION |
|---|
| 21 | 21 | | Sec. 2151.201. PROHIBITED EMPLOYMENT OF PERSONS CONVICTED |
|---|
| 22 | 22 | | OF CERTAIN SEXUAL OFFENSES. An owner or operator of an amusement |
|---|
| 23 | 23 | | park may not employ in an amusement park a person who has been |
|---|
| 24 | 24 | | convicted of, entered a plea of nolo contendere or guilty to, or |
|---|
| 25 | 25 | | received deferred adjudication for a sexual offense as defined by |
|---|
| 26 | 26 | | Chapter 21, Penal Code. |
|---|
| 27 | 27 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
