66 relating to a water rights permit issued to the Upper Guadalupe
77 River Authority.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 642, Acts of the 80th Legislature,
1010 Regular Session, 2007, is amended by adding Section 1A to read as
1111 follows:
1212 Sec. 1A. To help facilitate the statewide and regional
1313 goals of making efficient and responsible use of the state's water
1414 resources, the Upper Guadalupe River Authority may contract to
1515 provide any Kerr County entity, and may otherwise use in Kerr
1616 County, water for municipal use under Permit No. 5394A, which was
1717 issued to the Upper Guadalupe River Authority by the Texas Natural
1818 Resource Conservation Commission, the predecessor agency to the
1919 Texas Commission on Environmental Quality. This section supersedes
2020 Permit No. 5394A, and specifically Special Condition No. 5D.i of
2121 the permit, to the extent of any conflict.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
