8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 642, Acts of the 80th Legislature, | |
10 | 10 | Regular Session, 2007, is amended by adding Section 1A to read as | |
11 | 11 | follows: | |
12 | 12 | Sec. 1A. To help facilitate the statewide and regional | |
13 | 13 | goals of making efficient and responsible use of the state's water | |
14 | 14 | resources, the Upper Guadalupe River Authority may contract to | |
15 | 15 | provide any Kerr County entity, and may otherwise use in Kerr | |
16 | 16 | County, water for municipal use under Permit No. 5394A, which was | |
17 | 17 | issued to the Upper Guadalupe River Authority by the Texas Natural | |
18 | 18 | Resource Conservation Commission, the predecessor agency to the | |
19 | 19 | Texas Commission on Environmental Quality. This section supersedes | |
20 | 20 | Permit No. 5394A, and specifically Special Condition No. 5D.i of | |
21 | 21 | the permit, to the extent of any conflict. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2009. |
