| 7 | 7 | | relating to setting aside for TEXAS grant funding tuition paid by |

| 8 | 8 | | students at campuses maintained by public institutions of higher |
|---|
| 9 | 9 | | education outside the United States. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 56.310, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (d) to read as follows: |
|---|
| 13 | 13 | | (d) The governing board of an institution of higher |
|---|
| 14 | 14 | | education that maintains a campus outside the United States shall |
|---|
| 15 | 15 | | cause to be set aside five percent of the amount of the tuition |
|---|
| 16 | 16 | | charged to a student enrolled at the campus for the purposes of this |
|---|
| 17 | 17 | | subchapter. The amount of a student's tuition set aside under this |
|---|
| 18 | 18 | | subsection is in addition to an amount that may otherwise be |
|---|
| 19 | 19 | | required by law to be set aside from that tuition to provide funds |
|---|
| 20 | 20 | | for student financial aid. |
|---|
| 21 | 21 | | SECTION 2. The change in law made by this Act applies |
|---|
| 22 | 22 | | beginning with tuition charged by a public institution of higher |
|---|
| 23 | 23 | | education for the 2009-2010 academic year. Tuition charged by a |
|---|
| 24 | 24 | | public institution of higher education for an academic year before |
|---|
| 25 | 25 | | that academic year is covered by the law in effect before the |
|---|
| 26 | 26 | | effective date of this Act, and the former law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
