55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to setting aside for TEXAS grant funding tuition paid by
88 students at campuses maintained by public institutions of higher
99 education outside the United States.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 56.310, Education Code, is amended by
1212 adding Subsection (d) to read as follows:
1313 (d) The governing board of an institution of higher
1414 education that maintains a campus outside the United States shall
1515 cause to be set aside five percent of the amount of the tuition
1616 charged to a student enrolled at the campus for the purposes of this
1717 subchapter. The amount of a student's tuition set aside under this
1818 subsection is in addition to an amount that may otherwise be
1919 required by law to be set aside from that tuition to provide funds
2020 for student financial aid.
2121 SECTION 2. The change in law made by this Act applies
2222 beginning with tuition charged by a public institution of higher
2323 education for the 2009-2010 academic year. Tuition charged by a
2424 public institution of higher education for an academic year before
2525 that academic year is covered by the law in effect before the
2626 effective date of this Act, and the former law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
