 A BILL TO BE ENTITLED
 AN ACT
 relating to setting aside for TEXAS grant funding tuition paid by
 students at campuses maintained by public institutions of higher
 education outside the United States.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 56.310, Education Code, is amended by
 adding Subsection (d) to read as follows:
 (d)  The governing board of an institution of higher
 education that maintains a campus outside the United States shall
 cause to be set aside five percent of the amount of the tuition
 charged to a student enrolled at the campus for the purposes of this
 subchapter. The amount of a student's tuition set aside under this
 subsection is in addition to an amount that may otherwise be
 required by law to be set aside from that tuition to provide funds
 for student financial aid.
 SECTION 2. The change in law made by this Act applies
 beginning with tuition charged by a public institution of higher
 education for the 2009-2010 academic year. Tuition charged by a
 public institution of higher education for an academic year before
 that academic year is covered by the law in effect before the
 effective date of this Act, and the former law is continued in
 effect for that purpose.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
