55 relating to the maximum speed limit for a neighborhood electric
66 vehicle being operated on a street or highway and to the operation

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subdivision (1), Section 551.301,
1010 Transportation Code, as amended by Chapters 281 (H.B. 2702) and
1111 1242 (H.B. 1596), Acts of the 79th Legislature, Regular Session,
1212 2005, is reenacted and amended to read as follows:
1313 (1) "Neighborhood electric vehicle" means a vehicle
1414 that can attain a maximum speed of 35 miles per hour on a paved level
1515 surface and otherwise complies with [subject to] Federal Motor
1616 Vehicle Safety Standard 500 (49 C.F.R. Section 571.500).
1717 SECTION 2. Subsection (a), Section 551.303, Transportation
1818 Code, is amended to read as follows:
1919 (a) A neighborhood electric vehicle may be operated only on
2020 a street or highway for which the posted speed limit is 45 [35]
2121 miles per hour or less. A neighborhood electric vehicle may cross a
2222 road or street at an intersection where the road or street has a
2323 posted speed limit of more than 45 [35] miles per hour. A
2424 neighborhood electric vehicle may not be operated on a street or
2525 highway at a speed that exceeds the lesser of:
2626 (1) the posted speed limit; or
2727 (2) 35 miles per hour.
2828 SECTION 3. Subsection (a), Section 521.001, Transportation
2929 Code, is amended by adding Subdivision (6-a) to read as follows:
3030 (6-a) "Motorcycle" includes an enclosed three-wheeled
3131 passenger vehicle that:
3232 (A) is designed to operate with three wheels in
3333 contact with the ground;
3434 (B) has a minimum unladen weight of 900 lbs.;
3535 (C) has a single, completely enclosed, occupant
3636 compartment;
3737 (D) at a minimum, is equipped with:
3838 (i) seats that are certified by the vehicle
3939 manufacturer to meet the requirements of Federal Motor Vehicle
4040 Safety Standard No. 207, 49 C.F.R. Section 571.207;
4141 (ii) a steering wheel used to maneuver the
4242 vehicle;
4343 (iii) a propulsion unit located in front of
4444 or behind the enclosed occupant compartment;
4545 (iv) a seat belt for each vehicle occupant
4646 certified by the manufacturer to meet the requirements of Federal
4747 Motor Vehicle Safety Standard No. 209, 49 C.F.R. Section 571.209;
4848 (v) a windshield and one or more windshield
4949 wipers certified by the manufacturer to meet the requirements of
5050 Federal Motor Vehicle Safety Standard No. 205, 49 C.F.R. Section
5151 571.205, and Federal Motor Vehicle Safety Standard No. 104, 49
5252 C.F.R. Section 571.104; and
5353 (vi) a vehicle structure certified by the
5454 vehicle manufacturer to meet the requirements of Federal Motor
5555 Vehicle Safety Standard No. 216, 49 C.F.R. Section 571.216; and
5656 (E) is produced by its manufacturer in a minimum
5757 quantity of 300 in any calendar year.
5858 SECTION 4. Section 521.085, Transportation Code, is amended
5959 to read as follows:
6060 Sec. 521.085. TYPE OF VEHICLE AUTHORIZED. (a) Unless
6161 prohibited by Chapter 522, and except as provided by Subsection
6262 (b), the license holder may operate any vehicle of the type for
6363 which that class of license is issued and any lesser type of vehicle
6464 other than a motorcycle or moped.
6565 (b) Subsection (a) does not prohibit a license holder from
6666 operating a lesser type of vehicle that is a motorcycle described by
6767 Section 521.001(a)(6-a).
6868 SECTION 5. Subdivision (1), Section 661.001,
6969 Transportation Code, is amended to read as follows:
7070 (1) "Motorcycle" means a motor vehicle designed to
7171 propel itself with not more than three wheels in contact with the
7272 ground, and having a saddle for the use of the rider. The term does
7373 not include a tractor or a three-wheeled vehicle equipped with a cab
7474 or occupant compartment, seat, and seat belt and designed to
7575 contain the operator in the cab or occupant compartment.
7676 SECTION 6. Section 680.013, Transportation Code, is amended
7777 to read as follows:
7878 Sec. 680.013. USE OF PREFERENTIAL LANE BY MOTORCYCLE. A
7979 motorcycle, including a motorcycle described by Section
8080 521.001(a)(6-a), may be operated in a preferential lane that is not
8181 closed to all vehicular traffic.
8282 SECTION 7. This Act takes effect September 1, 2009.
