| 5 | 5 | | relating to the regulation of stormwater management by certain |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 573.001, Local Government Code, as |
|---|
| 9 | 9 | | effective April 1, 2009, is amended to read as follows: |
|---|
| 10 | 10 | | Sec. 573.001. COUNTY OR DISTRICT SUBJECT TO CHAPTER. This |
|---|
| 11 | 11 | | chapter applies only to: |
|---|
| 12 | 12 | | (1) a county with a population of 2.8 million or more; |
|---|
| 13 | 13 | | (2) a district or authority created under Section 59, |
|---|
| 14 | 14 | | Article XVI, Texas Constitution, that: |
|---|
| 15 | 15 | | (A) has boundaries coterminous with a county |
|---|
| 16 | 16 | | described by Subdivision (1); and |
|---|
| 17 | 17 | | (B) is authorized to provide stormwater drainage |
|---|
| 18 | 18 | | and flood control facilities; [or] |
|---|
| 19 | 19 | | (3) a county with a population of more than 1.3 million |
|---|
| 20 | 20 | | for which the primary source of drinking water is an underground |
|---|
| 21 | 21 | | aquifer; or |
|---|
| 22 | 22 | | (4) a county with a population of 800,000 or more that |
|---|
| 23 | 23 | | contains a portion of the Edwards Aquifer. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
