| 5 | 5 | | relating to the formula funding for public institutions of higher |

| 6 | 6 | | education for certain credit hours that do not count toward a |

| 7 | 7 | | degree. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (d), Section 61.0595, Education Code, |
|---|
| 10 | 10 | | is amended to read as follows: |
|---|
| 11 | 11 | | (d) The following are not counted for purposes of |
|---|
| 12 | 12 | | determining whether the student has previously earned the number of |
|---|
| 13 | 13 | | semester credit hours specified by Subsection (a): |
|---|
| 14 | 14 | | (1) semester credit hours earned by the student before |
|---|
| 15 | 15 | | receiving an associate or [a] baccalaureate degree that has |
|---|
| 16 | 16 | | previously been awarded to the student; |
|---|
| 17 | 17 | | (2) semester credit hours earned by the student by |
|---|
| 18 | 18 | | examination or under any other procedure by which credit is earned |
|---|
| 19 | 19 | | without registering for a course for which tuition is charged; |
|---|
| 20 | 20 | | (3) credit for a remedial education course, a |
|---|
| 21 | 21 | | technical course, a workforce education course funded according to |
|---|
| 22 | 22 | | contact hours, a dual credit course for which the student received |
|---|
| 23 | 23 | | credit toward a high school diploma, or another course that does not |
|---|
| 24 | 24 | | count toward a degree program at the institution; and |
|---|
| 25 | 25 | | (4) semester credit hours earned by the student at a |
|---|
| 26 | 26 | | private institution or an out-of-state institution. |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 28 | 28 | | 61.0595, Education Code, applies beginning with the funding |
|---|
| 29 | 29 | | recommendations made under Section 61.059, Education Code, for the |
|---|
| 30 | 30 | | 2011-2012 academic year. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
