55 AN ACT
66 relating to the establishment of an advisory committee to assist
77 the Texas Water Development Board in incorporating the potential
88 effects of climate variability into the state water plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. CREATION, PURPOSE, AND COMPOSITION OF ADVISORY
1111 COMMITTEE. The executive administrator of the Texas Water
1212 Development Board shall appoint an advisory committee to assist the
1313 board in incorporating the potential effects of climate variability
1414 into the 2012 state water plan. The advisory committee shall
1515 consist of experts from any field who have experience in the process
1616 of creating a regional water plan.
1717 SECTION 2. DUTIES OF ADVISORY COMMITTEE. The advisory
1818 committee shall:
1919 (1) assess past and predicted variations in climate;
2020 (2) assess the potential effects of climate
2121 variability on:
2222 (A) groundwater resources;
2323 (B) surface water resources; and
2424 (C) water demand;
2525 (3) review case studies of major water providers that
2626 include quantitative sensitivity analyses for water demand and
2727 supply under a range of climate variation scenarios;
2828 (4) review and analyze information regarding natural
2929 climate variability to determine whether an area of this state is
3030 experiencing a new drought of record;
3131 (5) assess existing global climate models to determine
3232 whether the models may be helpful in water planning on a regional or
3333 local level;
3434 (6) make recommendations for improving the collection
3535 of general information regarding:
3636 (A) groundwater resources;
3737 (B) surface water resources;
3838 (C) evapotranspiration; and
3939 (D) water use; and
4040 (7) make recommendations for the use of innovative
4141 water technologies that will help mitigate water supply issues, in
4242 addition to those water supply issues that would be experienced in a
4343 drought of record, including:
4444 (A) desalination technology;
4545 (B) water reuse technology; and
4646 (C) other emerging technologies.
4747 SECTION 3. REPORT. Not later than December 1 of each
4848 even-numbered year, the advisory committee shall submit its
4949 findings and recommendations to:
5050 (1) the Texas Water Development Board;
5151 (2) the governor; and
5252 (3) the relevant committees of the senate and house of
5353 representatives.
5454 SECTION 4. ADVISORY COMMITTEE ABOLISHED; EXPIRATION OF ACT.
5555 The advisory committee is abolished and this Act expires January 1,
5656 2013.
5757 SECTION 5. EFFECTIVE DATE. This Act takes effect
5858 immediately if it receives a vote of two-thirds of all the members
5959 elected to each house, as provided by Section 39, Article III, Texas
6060 Constitution. If this Act does not receive the vote necessary for
6161 immediate effect, this Act takes effect September 1, 2009.
