11 | 11 | | production of cement. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 271.907, Local Government Code, is |
---|
14 | 14 | | amended by amending Subsection (d) and adding Subsection (e) to |
---|
15 | 15 | | read as follows: |
---|
16 | 16 | | (d) A preference provided by Subsection (c) or (e) [The |
---|
17 | 17 | | preference] may be given only if the cost to the governmental agency |
---|
18 | 18 | | for the goods or services would not exceed 105 percent of the cost |
---|
19 | 19 | | of the goods or services provided by a vendor who does not meet the |
---|
20 | 20 | | standards. |
---|
21 | 21 | | (e) A governmental agency procuring goods or services that |
---|
22 | 22 | | involve the production of cement may give preference to goods or |
---|
23 | 23 | | services of a vendor that demonstrates that the cement was produced |
---|
24 | 24 | | from a portland cement kiln that: |
---|
25 | 25 | | (1) utilizes a dry raw material feed precalciner |
---|
26 | 26 | | pyroprocessing technology; and |
---|
27 | 27 | | (2) meets or exceeds regulatory requirements for |
---|
28 | 28 | | emissions of nitrogen oxide. |
---|
29 | 29 | | SECTION 2. This Act takes effect September 1, 2009. |
