| 6 | 6 | | relating to the evaluation of certain regional planning |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. (a) Before June 1, 2010, the state auditor |
|---|
| 10 | 10 | | shall audit a regional planning commission created under Chapter |
|---|
| 11 | 11 | | 391, Local Government Code, that includes a county with a |
|---|
| 12 | 12 | | population of 3.3 million or more, according to the most recent |
|---|
| 13 | 13 | | federal decennial census. The cost of the audit shall be paid for |
|---|
| 14 | 14 | | by the regional planning commission. |
|---|
| 15 | 15 | | (b) On or before June 1, 2010, the state auditor shall |
|---|
| 16 | 16 | | submit a report of an audit conducted under Subsection (a) of this |
|---|
| 17 | 17 | | section to: |
|---|
| 18 | 18 | | (1) the commissioners court of a county with a |
|---|
| 19 | 19 | | population of 3.3 million or more, according to the most recent |
|---|
| 20 | 20 | | federal decennial census, that is a member of a regional planning |
|---|
| 21 | 21 | | commission described by Subsection (a) of this section; and |
|---|
| 22 | 22 | | (2) the governing body of any other political |
|---|
| 23 | 23 | | subdivision that is a member of a regional planning commission |
|---|
| 24 | 24 | | described by Subsection (a) of this section, if the governing body |
|---|
| 25 | 25 | | requests a report from the state auditor. |
|---|
| 26 | 26 | | (c) This section expires January 1, 2011. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
