8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 29.0161, Education Code, is amended to | |
10 | 10 | read as follows: | |
11 | 11 | Sec. 29.0161. CONTRACT WITH STATE OFFICE OF ADMINISTRATIVE | |
12 | 12 | HEARINGS FOR SPECIAL EDUCATION DUE PROCESS HEARINGS. The [Not | |
13 | 13 | later than December 1, 2003, the] agency and the State Office of | |
14 | 14 | Administrative Hearings shall [jointly determine whether it would | |
15 | 15 | be cost-effective for the agency to] enter an interagency contract | |
16 | 16 | for the purpose provided by this section. The [with the office | |
17 | 17 | under which the] office shall [would] conduct [all or part of] the | |
18 | 18 | agency's special education due process hearings under the terms of | |
19 | 19 | the contract and under 20 U.S.C. Section 1415 [and its subsequent | |

21 | 21 | SECTION 2. Not later than January 1, 2010, the Texas | |
22 | 22 | Education Agency and the State Office of Administrative Hearings | |
23 | 23 | shall execute the contract required by Section 29.0161, Education | |
24 | 24 | Code, as amended by this Act. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
