66 relating to the authority of certain transportation and transit
77 authorities to enforce compliance with high occupancy vehicle lane
88 restrictions by an automated enforcement system; providing for the
99 imposition of penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 451, Transportation Code,
1212 is amended by adding Section 451.0615 to read as follows:
1313 Sec. 451.0615. ENFORCEMENT OF HIGH OCCUPANCY VEHICLE LANES.
1414 (a) In this section:
1515 (1) "Automated enforcement system" means a system
1616 that:
1717 (A) consists of a camera or other electrical or
1818 mechanical device that produces photographic, electronic, video,
1919 or digital images of a motor vehicle; and
2020 (B) is used to enforce compliance with
2121 instructions for high occupancy vehicle lane restrictions.
2222 (2) "High occupancy vehicle lane" has the meaning
2323 assigned by Section 224.151.
2424 (3) "Official traffic-control device" has the meaning
2525 assigned by Section 541.304 and includes a traffic pylon and double
2626 white lines on a highway.
2727 (4) "Owner of a motor vehicle" means the owner of a
2828 motor vehicle as shown on the motor vehicle registration records of
2929 the department or the analogous department or agency of another
3030 state or county.
3131 (b) A board by resolution may implement an automated
3232 enforcement system and provide that the owner of a motor vehicle,
3333 other than an authorized emergency vehicle as defined by Section
3434 541.201, is liable to the authority for a penalty if the vehicle is
3535 operated in violation of the instructions of an official
3636 traffic-control device regarding entering or exiting a high
3737 occupancy vehicle lane.
3838 (b-1) A resolution adopted under Subsection (b) may not
3939 provide for the imposition of a penalty for a vehicle that is
4040 operated in violation of the minimum number of persons requirement
4141 for use of a high occupancy vehicle lane or for the purpose of
4242 enforcing compliance with posted speed limits.
4343 (c) The resolution adopted under this section must:
4444 (1) provide for a penalty of not more than $100;
4545 (2) authorize an attorney employed by the authority or
4646 an attorney with whom the authority contracts to bring suit to
4747 collect the penalty;
4848 (3) provide for notice of the violation to the owner of
4949 the motor vehicle that committed the violation;
5050 (4) require that a peace officer commissioned by the
5151 authority:
5252 (A) review images produced by the automated
5353 enforcement system to determine whether the vehicle was operated in
5454 violation of the instructions of an official traffic-control device
5555 regarding entering or exiting a high occupancy vehicle lane; and
5656 (B) notarize the notice of violation before the
5757 notice is mailed to the owner of the motor vehicle that committed
5858 the violation;
5959 (5) provide that a notice of violation is presumed to
6060 have been received on the fifth day after the date the notice is
6161 mailed if the notice was mailed to the owner of a motor vehicle;
6262 (6) provide procedures by which the owner of the motor
6363 vehicle may request an administrative adjudication hearing to
6464 contest the imposition or the amount of the penalty;
6565 (7) allow for the use of images produced by the
6666 automated enforcement system authorized by this section; and
6767 (8) provide for other procedures the board determines
6868 are necessary for the imposition of a penalty authorized by this
6969 section.
7070 (d) Except as provided by Subsection (e), an image produced
7171 by an automated enforcement system may not be used to prosecute a
7272 criminal offense.
7373 (e) An image produced by an automated enforcement system may
7474 be used to prosecute a criminal offense defined by Chapter 19, 20,
7575 20A, 31, 38, or 49, Penal Code.
7676 (f) This section does not apply to an authority in which the
7777 principal municipality has a population of more than 1.9 million.
7878 SECTION 2. Subchapter B, Chapter 452, Transportation Code,
7979 is amended by adding Section 452.0615 to read as follows:
8080 Sec. 452.0615. ENFORCEMENT OF HIGH OCCUPANCY VEHICLE LANES.
8181 (a) In this section:
8282 (1) "Automated enforcement system" means a system
8383 that:
8484 (A) consists of a camera or other electrical or
8585 mechanical device that produces photographic, electronic, video,
8686 or digital images of a motor vehicle; and
8787 (B) is used to enforce compliance with
8888 instructions for high occupancy vehicle lane restrictions.
8989 (2) "High occupancy vehicle lane" has the meaning
9090 assigned by Section 224.151.
9191 (3) "Official traffic-control device" has the meaning
9292 assigned by Section 541.304 and includes a traffic pylon and double
9393 white lines on a highway.
9494 (4) "Owner of a motor vehicle" means the owner of a
9595 motor vehicle as shown on the motor vehicle registration records of
9696 the department or the analogous department or agency of another
9797 state or county.
9898 (b) This section applies only to an authority that:
9999 (1) consists of one subregion governed by a
100100 subregional board created under Subchapter O; and
101101 (2) has entered into an agreement with a governmental
102102 entity to:
103103 (A) operate a high occupancy vehicle lane; or
104104 (B) provide peace officers to enforce compliance
105105 with instructions for high occupancy vehicle lane restrictions.
106106 (c) A board by resolution may implement an automated
107107 enforcement system and provide that the owner of a motor vehicle,
108108 other than an authorized emergency vehicle as defined by Section
109109 541.201, is liable to the authority for a penalty if the vehicle is
110110 operated in violation of the instructions of an official
111111 traffic-control device regarding entering or exiting a high
112112 occupancy vehicle lane.
113113 (c-1) A resolution adopted under Subsection (c) may not
114114 provide for the imposition of a penalty for a vehicle that is
115115 operated in violation of the minimum number of persons requirement
116116 for use of a high occupancy vehicle lane or for the purpose of
117117 enforcing compliance with posted speed limits.
118118 (d) The resolution adopted under this section must:
119119 (1) provide for a penalty of not more than $100;
120120 (2) authorize an attorney employed by the authority or

145145 (e) Except as provided by Subsection (f), an image produced
146146 by an automated enforcement system may not be used to prosecute a
147147 criminal offense.
148148 (f) An image produced by an automated enforcement system may
149149 be used to prosecute a criminal offense defined by Chapter 19, 20,
150150 20A, 31, 38, or 49, Penal Code.
151151 SECTION 3. This Act takes effect September 1, 2009.
