10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter B, Chapter 531, Government Code, is | |
12 | 12 | amended by adding Section 531.0974 to read as follows: | |
13 | 13 | Sec. 531.0974. ELECTRONIC MEDICAL RECORD. (a) The | |
14 | 14 | executive commissioner shall adopt rules requiring the creation and | |
15 | 15 | use of an electronic medical record for each person who enrolls in | |
16 | 16 | the Medicaid program or the child health plan under Chapter 62, | |
17 | 17 | Health and Safety Code, on or after December 1, 2009. | |
18 | 18 | (b) The executive commissioner by rule shall determine the | |
19 | 19 | information required to be included in an electronic medical record | |
20 | 20 | created under this section. | |
21 | 21 | SECTION 2. If before implementing any provision of this Act | |
22 | 22 | a state agency determines that a waiver or authorization from a | |
23 | 23 | federal agency is necessary for implementation of that provision, | |
24 | 24 | the agency affected by the provision shall request the waiver or | |
25 | 25 | authorization and may delay implementing that provision until the | |
26 | 26 | waiver or authorization is granted. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2009. |
