66 AN ACT
77 relating to the creation of an electronic medical record for
88 certain individuals enrolled in the Medicaid or child health plan
99 program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.0974 to read as follows:
1313 Sec. 531.0974. ELECTRONIC MEDICAL RECORD. (a) The
1414 executive commissioner shall adopt rules requiring the creation and
1515 use of an electronic medical record for each person who enrolls in
1616 the Medicaid program or the child health plan under Chapter 62,
1717 Health and Safety Code, on or after December 1, 2009.
1818 (b) The executive commissioner by rule shall determine the
1919 information required to be included in an electronic medical record
2020 created under this section.
2121 SECTION 2. If before implementing any provision of this Act
2222 a state agency determines that a waiver or authorization from a
2323 federal agency is necessary for implementation of that provision,
2424 the agency affected by the provision shall request the waiver or
2525 authorization and may delay implementing that provision until the
2626 waiver or authorization is granted.
2727 SECTION 3. This Act takes effect September 1, 2009.
