 A BILL TO BE ENTITLED
 AN ACT
 relating to the creation of an electronic medical record for
 certain individuals enrolled in the Medicaid or child health plan
 program.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter B, Chapter 531, Government Code, is
 amended by adding Section 531.0974 to read as follows:
 Sec. 531.0974.  ELECTRONIC MEDICAL RECORD. (a) The
 executive commissioner shall adopt rules requiring the creation and
 use of an electronic medical record for each person who enrolls in
 the Medicaid program or the child health plan under Chapter 62,
 Health and Safety Code, on or after December 1, 2009.
 (b)  The executive commissioner by rule shall determine the
 information required to be included in an electronic medical record
 created under this section.
 SECTION 2. If before implementing any provision of this Act
 a state agency determines that a waiver or authorization from a
 federal agency is necessary for implementation of that provision,
 the agency affected by the provision shall request the waiver or
 authorization and may delay implementing that provision until the
 waiver or authorization is granted.
 SECTION 3. This Act takes effect September 1, 2009.
