99 AN ACT
1010 relating to the definition of a playground for purposes of certain
1111 places protected from certain criminal activities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subdivision (3), Subsection (a), Section
1414 481.134, Health and Safety Code, is amended to read as follows:
1515 (3) "Playground" means any outdoor facility that is
1616 not on the premises of a school and that:
1717 (A) is intended for recreation;
1818 (B) is open to the public; and
1919 (C) contains three or more play stations
2020 [separate apparatus] intended for the recreation of children, such
2121 as slides, swing sets, and teeterboards.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an offense committed on or after the effective date of this Act.
2424 An offense committed before the effective date of this Act is
2525 covered by the law in effect when the offense was committed, and the
2626 former law is continued in effect for that purpose. For purposes of
2727 this section, an offense was committed before the effective date of
2828 this Act if any element of the offense was committed before that
2929 date.
3030 SECTION 3. This Act takes effect September 1, 2009.
