1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the establishment of the Interagency Literacy Council
1313 for the study, promotion, and enhancement of literacy in this
1414 state.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subtitle B, Title 4, Labor Code, is amended by
1717 adding Chapter 312 to read as follows:
1818 CHAPTER 312. INTERAGENCY LITERACY COUNCIL
1919 Sec. 312.001. DEFINITION. In this chapter, "council" means
2020 the Interagency Literacy Council established under this chapter.
2121 Sec. 312.002. APPLICATION OF SUNSET ACT. The Interagency
2222 Literacy Council is subject to Chapter 325, Government Code (Texas
2323 Sunset Act). Unless continued in existence as provided by that
2424 chapter, the council is abolished and this chapter expires
2525 September 1, 2019.
2626 Sec. 312.003. ESTABLISHMENT AND COMPOSITION. (a) The
2727 commission shall establish the Interagency Literacy Council. The
2828 council is composed of nine members as follows:
2929 (1) a representative of the commission, appointed by
3030 the executive director;
3131 (2) a representative of the Texas Education Agency,
3232 appointed by the commissioner of education;
3333 (3) a representative of the Texas Higher Education
3434 Coordinating Board, appointed by the commissioner of higher
3535 education; and
3636 (4) six public members who are leaders of the business
3737 or nonprofit community engaged in literacy promotion efforts,
3838 appointed by the executive director of the commission.
3939 (b) The representative appointed under Subsection (a)(1)
4040 shall serve as the presiding officer of the council.
4141 Sec. 312.004. COMMISSION DUTIES. The commission shall
4242 provide staff and resources as necessary for the operation of the
4343 council.
4444 Sec. 312.005. TERMS; VACANCY. (a) Members of the council
4545 serve two-year terms, with the terms expiring February 1 of each
4646 odd-numbered year.
4747 (b) A member may be reappointed.
4848 (c) A vacancy on the council shall be filled for the
4949 remainder of the unexpired term in the same manner as provided by
5050 Section 312.003(a).
5151 Sec. 312.006. MEETINGS. (a) The council shall meet in
5252 person at least three times each year and may hold meetings by
5353 conference call if necessary. The council shall invite
5454 stakeholders to participate in at least one council meeting each
5555 year and provide an opportunity for submission of oral or written
5656 testimony.
5757 (b) Section 551.125, Government Code, applies to a meeting
5858 held by conference call under this section, except that Section
5959 551.125(b), Government Code, does not apply.
6060 Sec. 312.007. COMPENSATION; REIMBURSEMENT. (a) A member
6161 of the council may not receive compensation for service on the
6262 council.
6363 (b) A public member may be reimbursed for the member's
6464 actual and necessary expenses for meals, lodging, and
6565 transportation incurred while performing council business, subject
6666 to any applicable limitation on reimbursement prescribed by the
6767 General Appropriations Act.
6868 Sec. 312.008. COUNCIL POWERS AND DUTIES. The council
6969 shall:
7070 (1) study current research to assess the adult
7171 literacy needs in this state, including literacy needs relating to
7272 business and finance, workforce and technology, civics, and health
7373 and wellness;
7474 (2) consult with key stakeholders to identify:
7575 (A) barriers to improving literacy; and
7676 (B) evidence-based best practices for improving
7777 literacy;
7878 (3) review the status of the programs and services
7979 administered by each agency or entity represented on the council
8080 that promote literacy in an effort to coordinate efforts, align
8181 services, reduce redundancies, implement best practices, integrate
8282 support services, and improve accountability;
8383 (4) build existing funding streams and identify
8484 additional state and federal funding sources available for the
8585 promotion of literacy in this state; and
8686 (5) raise literacy awareness and engage community
8787 leaders in creative solution building for improving literacy in
8888 this state.
8989 Sec. 312.009. STATEWIDE LITERACY PLAN; REPORT. (a) The
9090 council shall develop a comprehensive statewide action plan for the
9191 improvement of literacy in this state, including a recommended
9292 timeline for implementation.
9393 (b) The council shall submit to both houses of the
9494 legislature, the governor, and the Texas Workforce Investment
9595 Council on or before November 1 of each even-numbered year a written
9696 report on:
9797 (1) the development of the council's statewide action
9898 plan;
9999 (2) the actions taken in furtherance of the plan;
100100 (3) the areas that need improvement in implementing
101101 the plan;
102102 (4) any change to the plan; and
103103 (5) the programs and services that address literacy
104104 needs in this state.
105105 Sec. 312.010. GIFTS, GRANTS, AND DONATIONS. The commission
106106 may accept for the council a gift, grant, or donation from any
107107 source to carry out the purposes of this chapter.
108108 Sec. 312.011. RULES. The commission may adopt rules
109109 necessary to implement this chapter.
110110 SECTION 2. (a) The Interagency Literacy Council shall
111111 submit the initial report required under Subsection (b), Section
112112 312.009, Labor Code, as added by this Act, not later than November
113113 1, 2012.
114114 (b) As soon as practicable after the effective date of this
115115 Act, the designated appointing officials shall appoint the members
116116 to the Interagency Literacy Council established under Chapter 312,
117117 Labor Code, as added by this Act.
118118 SECTION 3. This Act takes effect immediately if it receives
119119 a vote of two-thirds of all the members elected to each house, as
120120 provided by Section 39, Article III, Texas Constitution. If this
121121 Act does not receive the vote necessary for immediate effect, this
122122 Act takes effect September 1, 2009.
