| 6 | 6 | | designate a person to receive fees, commissions, or costs. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subsection (a), Section 114.001, Local |
|---|
| 9 | 9 | | Government Code, is amended to read as follows: |
|---|
| 10 | 10 | | (a) Each report required under this subtitle must be made in |
|---|
| 11 | 11 | | writing and must be sworn to before an officer authorized to |
|---|
| 12 | 12 | | administer oaths by the officer making the report or by a person |
|---|
| 13 | 13 | | designated by the officer to receive fees, commissions, or costs |
|---|
| 14 | 14 | | under Section 114.041(b) [before an officer authorized to |
|---|
| 15 | 15 | | administer oaths]. |

| 16 | 16 | | SECTION 2. Subsection (b), Section 114.041, Local |
|---|
| 17 | 17 | | Government Code, is amended to read as follows: |
|---|
| 18 | 18 | | (b) In a county with a population of more than 190,000, a |
|---|
| 19 | 19 | | district, county, or precinct officer shall keep, as part of a |
|---|
| 20 | 20 | | record provided for the purpose by the proper county authorities, a |
|---|
| 21 | 21 | | statement of the amounts earned by the officer and of the money |
|---|
| 22 | 22 | | received by the officer as fees, commissions, or costs. The officer |
|---|
| 23 | 23 | | may designate a person to receive the money as fees, commissions, or |
|---|
| 24 | 24 | | costs on behalf of the officer under this subsection. The officer |
|---|
| 25 | 25 | | or a person designated by the officer to receive the fees, |
|---|
| 26 | 26 | | commissions, or costs must make an entry in the record when the |
|---|
| 27 | 27 | | fees, commissions, or costs are earned and when they are received. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
