1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to developing a developmental education plan for students
1313 entering public institutions of higher education.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1616 amended by adding Section 61.07611 to read as follows:
1717 Sec. 61.07611. DEVELOPMENTAL EDUCATION PLAN; REPORT.
1818 (a) To serve students who require developmental education in an
1919 effective and cost-effective manner, the board shall develop a
2020 statewide plan for developmental education to be provided under
2121 Section 51.3062 that:
2222 (1) assigns primary responsibility for developmental
2323 education to public junior colleges and public technical
2424 institutes; and
2525 (2) provides for using technology, to the greatest
2626 extent practicable consistent with best practices, to provide
2727 developmental education to students.
2828 (b) In developing the developmental education plan, the
2929 board shall:
3030 (1) research issues related to developmental
3131 education;
3232 (2) study and develop best practices for successful
3333 developmental education programs, including through use of pilot
3434 programs; and
3535 (3) assess various methods of providing developmental
3636 education to students to determine which methods, if any, should be
3737 implemented on a statewide basis.
3838 (c) Developmental education under the plan must include:
3939 (1) technological delivery of developmental education
4040 courses that allows students to complete course work;
4141 (2) diagnostic assessments to determine a student's
4242 specific educational needs to allow for appropriate developmental
4343 instruction;
4444 (3) modular developmental education course materials;
4545 (4) employment of tutors and instructional aides to
4646 supplement developmental education course instruction as needed
4747 for particular students;
4848 (5) an internal monitoring mechanism to identify a
4949 student's area of academic difficulty;
5050 (6) periodic updates of developmental education
5151 course materials; and
5252 (7) assessments after completion of a developmental
5353 education course to determine a student's readiness to enroll in
5454 freshman-level academic courses.
5555 (d) The developmental education plan must provide for:
5656 (1) ongoing training for developmental education
5757 program faculty members, tutors, and instructional aides at the
5858 institutions or other locations where those persons provide
5959 instruction; and
6060 (2) ongoing research and improvement of appropriate
6161 developmental education programs, including participation by a
6262 group of institution of higher education faculty members selected
6363 by the board, to:
6464 (A) monitor results of the programs;
6565 (B) identify successful and unsuccessful program
6666 components; and
6767 (C) identify possible solutions to program
6868 problems.
6969 (e) Not later than December 1, 2010, the board shall submit
7070 to the governor, lieutenant governor, speaker of the house of
7171 representatives, and the presiding officer of each legislative
7272 standing committee with primary jurisdiction over higher education
7373 a report concerning the initial development of the developmental
7474 education plan under this section, including any recommendations
7575 for redesign or reassignment among institutions of higher education
7676 of existing programs or implementation of new programs and, if
7777 appropriate, recommendations for legislation. This subsection
7878 expires January 1, 2011.
7979 SECTION 2. This Act does not make an appropriation. A
8080 provision in this Act that creates a new governmental program,
8181 creates a new entitlement, or imposes a new duty on a governmental
8282 entity is not mandatory during a fiscal period for which the
8383 legislature has not made a specific appropriation to implement the
8484 provision.
8585 SECTION 3. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2009.
