66 relating to a notification requirement if a nurse is not assigned to

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1010 amended by adding Section 38.021 to read as follows:
1111 Sec. 38.021. PARENTAL NOTIFICATION CONCERNING SCHOOL
1212 NURSES. (a) A public school that does not have a full-time school
1313 nurse assigned to the campus for more than 30 consecutive
1414 instructional days during the same school year shall provide
1515 written notice of the absence of a nurse to the parent of or other
1616 person standing in parental relation to each student enrolled in
1717 the school.
1818 (b) The principal of the school shall provide the notice
1919 required by Subsection (a) not later than the 30th instructional
2020 day after the first day the school does not have a full-time school
2121 nurse assigned to the campus.
2222 (c) The school shall:
2323 (1) make a good faith effort to ensure that the notice
2424 required by this section is provided in a bilingual form to any
2525 parent or other person standing in parental relation whose primary
2626 language is not English; and
2727 (2) retain a copy of any notice provided under this
2828 section.
2929 SECTION 2. This Act applies beginning with the 2009-2010
3030 school year.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
