88 AN ACT
99 relating to an interim study on the creation of a data collection to
1010 track specialized technology research projects conducted by public
1111 universities, public university research facilities, and other
1212 state institutions.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. INTERIM STUDY REGARDING TECHNOLOGY RESEARCH DATA
1515 COLLECTION. (a) A select interim committee is created to study
1616 the feasibility of collecting data and maintaining a searchable
1717 electronic database, search engine, or other collection of data
1818 (data collection) relating to specialized technology research
1919 projects that are developed or conducted at public universities in
2020 this state, research facilities of public universities in this
2121 state, or other facilities operated by a state agency, in order to
2222 facilitate coordination among the universities and facilities on
2323 the projects and improve access to and awareness of the specialized
2424 research and technologies developed at those institutions and
2525 facilities.
2626 (b) The study must consider:
2727 (1) appropriate entities to administer the data
2828 collection, including nonprofit organizations, public universities
2929 in this state, or state agencies;
3030 (2) the extent of legislative oversight required for
3131 an entity that would maintain the data collection;
3232 (3) compliance with state and federal laws regarding
3333 access to public information; and
3434 (4) the information the data collection would include,
3535 such as:
3636 (A) a list of projects involving one or more of
3737 the following areas:
3838 (i) energy research, including methods of
3939 creation, storage, distribution, and conservation of energy;
4040 (ii) biomedical science research,
4141 including research that involves stem cells or human cloning;
4242 (iii) nanotechnology research, including
4343 nanomedicine; and
4444 (iv) other specialized technology
4545 research;
4646 (B) for each project listed under Paragraph (A)
4747 of this subdivision, a brief description of the project, including
4848 the field of technology involved, the entity involved with the
4949 project, and additional comments regarding the research the Texas
5050 Higher Education Coordinating Board considers appropriate; and
5151 (C) other relevant information and available
5252 resources in this state relating to specialized technology
5353 research, including:
5454 (i) expert faculty or research personnel;
5555 (ii) available technology and patents
5656 obtained;
5757 (iii) the location of and policies for the
5858 use of available research equipment;
5959 (iv) public grants or contracts awarded;
6060 and
6161 (v) the process through which any stem
6262 cells and stem cell lines utilized were derived.
6363 (c) The study shall examine the current state of access to
6464 public information about specialized technology research projects
6565 and shall assess the best methods of facilitating access to the
6666 information. In addition, the study shall consider what
6767 information should be accessible by the general public and what
6868 information, if any, should have restricted access.
6969 (d) The committee shall be composed of:
7070 (1) representatives of the following university
7171 systems, with one member named by each system: The University of
7272 Texas System, The Texas A&M University System, the Texas Tech
7373 University System, the University of Houston System, and the
7474 University of North Texas System; and
7575 (2) a number of members appointed by the Texas Higher
7676 Education Coordinating Board as the coordinating board considers
7777 appropriate to represent the coordinating board, data collection
7878 providers, and the technology industry.
7979 (e) On the request of the committee, a general academic
8080 institution of higher education, research facility of a general
8181 academic institution of higher education, or other facility
8282 operated by a state agency shall provide to the Texas Higher
8383 Education Coordinating Board or advisory committee any information
8484 necessary for the board or advisory committee to perform its duties
8585 under this section.
8686 SECTION 2. COMMITTEE REPORT. Not later than December 1,
8787 2010, the committee shall report the committee's findings and
8888 recommendations to the lieutenant governor, the speaker of the
8989 house of representatives, and the governor. The committee shall
9090 include in its recommendations specific legislation that the
9191 committee considers desirable to address the need for and
9292 feasibility of establishing a data collection as determined by the
9393 committee's findings.
9494 SECTION 3. ABOLITION OF COMMITTEE. The committee is
9595 abolished and this Act expires January 16, 2011.
9696 SECTION 4. EFFECTIVE DATE. This Act takes effect
9797 immediately if it receives a vote of two-thirds of all the members
9898 elected to each house, as provided by Section 39, Article III, Texas
9999 Constitution. If this Act does not receive the vote necessary for
100100 immediate effect, this Act takes effect September 1, 2009.
