5	5	relating to the provision of information by health and human
6	6	services agencies to assist children with velocardiofacial
7	7	syndrome.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Subchapter D, Chapter 117, Human Resources Code,
10	10	is amended by adding Section 117.076 to read as follows:
11	11	Sec. 117.076. INFORMATION REGARDING VELOCARDIOFACIAL
12	12	SYNDROME. (a) The commission shall ensure that each health and
13	13	human services agency that provides intervention services to young
14	14	children is provided with information developed by the commission
15	15	regarding velocardiofacial syndrome.
16	16	(b) Each health and human services agency described by
17	17	Subsection (a) shall provide the information regarding
18	18	velocardiofacial syndrome to appropriate health care coordinators
19	19	and therapists and to parents of a child who is known by the agency
20	20	to have at least two of the following conditions:
21	21	(1) hypotonicity;
22	22	(2) communication delay;
23	23	(3) articulation disorder;
24	24	(4) resonance disorder;
25	25	(5) nasal regurgitation during feeding as an infant
26	26	with no history of a cleft palate;
27	27	(6) recurrent ear infections as well as diagnosis of
28	28	cardiac anomaly, feeding disorder, cleft palate, or submucosal
29	29	cleft palate; or
30	30	(7) fine motor or gross motor skills delay.
31	31	(c) The commission shall develop the information required
32	32	under Subsection (a) using medically accurate, peer-reviewed
33	33	literature. The information must include:
34	34	(1) an explanation of velocardiofacial syndrome
35	35	symptoms, diagnosis, and treatment options;
36	36	(2) information on relevant state agency and nonprofit
37	37	resources, parent support groups, and available Medicaid waiver
38	38	programs; and
39	39	(3) a recommendation for follow-up with a health care
40	40	provider for evaluation of the underlying etiology and an
41	41	explanation that the existence of any of the conditions listed in
42	42	Subsection (b) will not necessarily result in a diagnosis of
43	43	velocardiofacial syndrome.
44	44	(d) The executive commissioner may adopt rules as necessary
45	45	to implement this section.
46	46	SECTION 2. This Act takes effect September 1, 2009.
