55 relating to the requirements for a smoke detector in multifamily
66 and other residential units.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. This bill is enacted to honor the memory of
99 Sephra Burks.
1010 SECTION 2. Section 92.254, Property Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-1) to read as
1212 follows:
1313 (a) A smoke detector must be:
1414 (1) designed to detect both the visible and invisible
1515 products of combustion;
1616 (2) designed with an alarm audible to a person in the
1717 bedrooms it serves;
1818 (3) powered by battery, alternating current, or other
1919 power source as required by local ordinance;
2020 (4) tested and listed for use as a smoke detector by
2121 Underwriters Laboratories, Inc., Factory Mutual Research
2222 Corporation, or United States Testing Company, Inc.; and
2323 (5) in good working order.
2424 (a-1) If requested by a tenant as an accommodation for a
2525 person with a hearing-impairment disability or as required by law
2626 as a reasonable accommodation for a person with a
2727 hearing-impairment disability, a smoke detector must, in addition
2828 to complying with Subsection (a), be capable of alerting a
2929 hearing-impaired person in the bedrooms it serves.
3030 SECTION 3. This Act takes effect January 1, 2010.
