7 | 7 | | child-care facilities. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subsection (a), Section 42.0421, Human Resources |
---|
10 | 10 | | Code, is amended to read as follows: |
---|
11 | 11 | | (a) The minimum training standards prescribed by the |
---|
12 | 12 | | department under Section 42.042(p) for an employee of a day-care |
---|
13 | 13 | | center or group day-care home must include: |
---|
14 | 14 | | (1) 16 [eight] hours of initial training that must be |
---|
15 | 15 | | completed not later than the 90th day after the employee's first day |
---|
16 | 16 | | of employment for an employee of a day-care center who has no |
---|
17 | 17 | | previous training or less than two years of employment experience |
---|
18 | 18 | | in a regulated child-care facility, eight hours of which must [to] |
---|
19 | 19 | | be completed before the employee is given responsibility for a |
---|
20 | 20 | | group of children; |
---|
21 | 21 | | (2) 17 [15] hours of annual training for each employee |
---|
22 | 22 | | of a day-care center or group day-care home, excluding the |
---|
23 | 23 | | director, which must include at least six hours of training in one |
---|
24 | 24 | | or more of the following areas: |
---|
25 | 25 | | (A) child growth and development; |
---|
26 | 26 | | (B) guidance and discipline; |
---|
27 | 27 | | (C) age-appropriate curriculum; and |
---|
28 | 28 | | (D) teacher-child interaction; and |
---|
29 | 29 | | (3) 30 [20] hours of annual training for each director |
---|
30 | 30 | | of a day-care center or group day-care home, which must include at |
---|
31 | 31 | | least six hours of training in one or more of the following areas: |
---|
32 | 32 | | (A) child growth and development; |
---|
33 | 33 | | (B) guidance and discipline; |
---|
34 | 34 | | (C) age-appropriate curriculum; and |
---|
35 | 35 | | (D) teacher-child interaction. |
---|
36 | 36 | | SECTION 2. Section 42.0426, Human Resources Code, is |
---|
37 | 37 | | amended by adding Subsection (c) to read as follows: |
---|
38 | 38 | | (c) Not later than the seventh day after the date an |
---|
39 | 39 | | employee begins employment at a child-care facility, the employee |
---|
40 | 40 | | must complete an orientation to the facility. |
---|
41 | 41 | | SECTION 3. (a) Subdivision (1), Subsection (a), Section |
---|
42 | 42 | | 42.0421, Human Resources Code, as amended by this Act, and |
---|
43 | 43 | | Subsection (c), Section 42.0426, Human Resources Code, as added by |
---|
44 | 44 | | this Act, apply only to an employee who is initially employed by a |
---|
45 | 45 | | child-care facility on or after the effective date of this Act. An |
---|
46 | 46 | | employee who is initially employed by a child-care facility before |
---|
47 | 47 | | that date is subject to the law in effect immediately before the |
---|
48 | 48 | | effective date of this Act, and the former law is continued in |
---|
49 | 49 | | effect for that purpose. |
---|
50 | 50 | | (b) Subdivisions (2) and (3), Subsection (a), Section |
---|
51 | 51 | | 42.0421, Human Resources Code, as amended by this Act, apply to an |
---|
52 | 52 | | employee or director of a child-care facility regardless of the |
---|
53 | 53 | | date the person began employment with or service as director of the |
---|
54 | 54 | | child-care facility. |
---|
55 | 55 | | SECTION 4. This Act takes effect September 1, 2009. |
