55 AN ACT
66 relating to minimum training standards for employees of certain
77 child-care facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (a), Section 42.0421, Human Resources
1010 Code, is amended to read as follows:
1111 (a) The minimum training standards prescribed by the
1212 department under Section 42.042(p) for an employee of a day-care
1313 center or group day-care home must include:
1414 (1) 16 [eight] hours of initial training that must be
1515 completed not later than the 90th day after the employee's first day
1616 of employment for an employee of a day-care center who has no
1717 previous training or less than two years of employment experience
1818 in a regulated child-care facility, eight hours of which must [to]
1919 be completed before the employee is given responsibility for a
2020 group of children;
2121 (2) 17 [15] hours of annual training for each employee
2222 of a day-care center or group day-care home, excluding the
2323 director, which must include at least six hours of training in one
2424 or more of the following areas:
2525 (A) child growth and development;
2626 (B) guidance and discipline;
2727 (C) age-appropriate curriculum; and
2828 (D) teacher-child interaction; and
2929 (3) 30 [20] hours of annual training for each director
3030 of a day-care center or group day-care home, which must include at
3131 least six hours of training in one or more of the following areas:
3232 (A) child growth and development;
3333 (B) guidance and discipline;
3434 (C) age-appropriate curriculum; and
3535 (D) teacher-child interaction.
3636 SECTION 2. Section 42.0426, Human Resources Code, is
3737 amended by adding Subsection (c) to read as follows:
3838 (c) Not later than the seventh day after the date an
3939 employee begins employment at a child-care facility, the employee
4040 must complete an orientation to the facility.
4141 SECTION 3. (a) Subdivision (1), Subsection (a), Section
4242 42.0421, Human Resources Code, as amended by this Act, and
4343 Subsection (c), Section 42.0426, Human Resources Code, as added by
4444 this Act, apply only to an employee who is initially employed by a
4545 child-care facility on or after the effective date of this Act. An
4646 employee who is initially employed by a child-care facility before
4747 that date is subject to the law in effect immediately before the
4848 effective date of this Act, and the former law is continued in
4949 effect for that purpose.
5050 (b) Subdivisions (2) and (3), Subsection (a), Section
5151 42.0421, Human Resources Code, as amended by this Act, apply to an
5252 employee or director of a child-care facility regardless of the
5353 date the person began employment with or service as director of the
5454 child-care facility.
5555 SECTION 4. This Act takes effect September 1, 2009.
