55 relating to the regulation of the discharge of firearms and certain
66 other weapons by certain municipalities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 229, Local Government Code, is amended
99 by adding Section 229.003 to read as follows:
1010 Sec. 229.003. REGULATION OF DISCHARGE OF WEAPON BY CERTAIN
1111 MUNICIPALITIES. (a) This section applies only to a municipality
1212 located wholly or partly in a county:
1313 (1) with a population of 450,000 or more;
1414 (2) in which all or part of a municipality with a
1515 population of one million or more is located; and
1616 (3) that is located adjacent to a county with a
1717 population of two million or more.
1818 (b) Notwithstanding Section 229.002, a municipality may not
1919 apply a regulation relating to the discharge of firearms or other
2020 weapons in the extraterritorial jurisdiction of the municipality or
2121 in an area annexed by the municipality after September 1, 1981, if
2222 the firearm or other weapon is:
2323 (1) a shotgun, air rifle or pistol, BB gun, or bow and
2424 arrow discharged:
2525 (A) on a tract of land of 10 acres or more and:
2626 (i) more than 1,000 feet from:
2727 (a) the property line of a public
2828 tract of land, generally accessible by the public, that is
2929 routinely used for organized sporting or recreational activities or
3030 that has permanent recreational facilities or equipment; and
3131 (b) the property line of a school,
3232 hospital, or commercial day-care facility;
3333 (ii) more than 600 feet from:
3434 (a) the property line of a residential
3535 subdivision; and
3636 (b) the property line of a multifamily
3737 residential complex; and
3838 (iii) more than 150 feet from a residence or
3939 occupied building located on another property; and
4040 (B) in a manner not reasonably expected to cause
4141 a projectile to cross the boundary of the tract;
4242 (2) a center fire or rim fire rifle or pistol of any
4343 caliber discharged:
4444 (A) on a tract of land of 50 acres or more and:
4545 (i) more than 1,000 feet from:
4646 (a) the property line of a public
4747 tract of land, generally accessible by the public, that is
4848 routinely used for organized sporting or recreational activities or
4949 that has permanent recreational facilities or equipment; and
5050 (b) the property line of a school,
5151 hospital, or commercial day-care facility;
5252 (ii) more than 600 feet from:
5353 (a) the property line of a residential
5454 subdivision; and
5555 (b) the property line of a multifamily
5656 residential complex; and
5757 (iii) more than 300 feet from a residence or
5858 occupied building located on another property; and
5959 (B) in a manner not reasonably expected to cause
6060 a projectile to cross the boundary of the tract; or
6161 (3) discharged at a sport shooting range, as defined
6262 by Section 250.001, in a manner not reasonably expected to cause a
6363 projectile to cross the boundary of a tract of land.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2009.
