8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 2158.301, Government Code, as added by |
---|
10 | 10 | | Chapter 939 (H.B. 3693), Acts of the 80th Legislature, Regular |
---|
11 | 11 | | Session, 2007, is amended to read as follows: |
---|
12 | 12 | | Sec. 2158.301. ENERGY CONSERVATION: APPLIANCES, PRINTERS, |
---|
13 | 13 | | AND PHOTOCOPY MACHINES. (a) Unless the comptroller approves a |
---|
14 | 14 | | written request from a state agency for an exemption from the |
---|
15 | 15 | | requirements of this subsection [If available and cost-effective], |
---|
16 | 16 | | a state agency shall purchase equipment and appliances, including |
---|
17 | 17 | | printers and photocopy machines, for state use that meet or |
---|
18 | 18 | | exceed[: |
---|
19 | 19 | | [(1) the federal energy conservation standards under |
---|
20 | 20 | | Section 325, Energy Policy and Conservation Act (42 U.S.C. Section |
---|
21 | 21 | | 6295), or a federal regulation adopted under that Act; or |
---|
22 | 22 | | [(2)] the federal Energy Star standards designated by |
---|
23 | 23 | | the United States Environmental Protection Agency and the United |
---|
24 | 24 | | States Department of Energy. |
---|
25 | 25 | | (b) A printer or photocopy machine purchased by a state |
---|
26 | 26 | | agency must have duplexing capability and the ability to be |
---|
27 | 27 | | programmed to default to double-sided printing or copying. |
---|
28 | 28 | | (c) A state agency printer or photocopy machine that has |
---|
29 | 29 | | duplexing capability shall be programmed to default to double-sided |
---|
30 | 30 | | printing or copying. |
---|
31 | 31 | | (d) The comptroller shall collect data on appliances |
---|
32 | 32 | | purchased by state agencies and on the energy efficiency of the |
---|
33 | 33 | | appliances. |
---|
34 | 34 | | SECTION 2. Chapter 2158, Government Code, is amended by |
---|
35 | 35 | | adding Subchapter G to read as follows: |
---|
36 | 36 | | SUBCHAPTER G. LANDSCAPING EQUIPMENT |
---|
37 | 37 | | Sec. 2158.351. PURCHASE OF LANDSCAPING EQUIPMENT. |
---|
38 | 38 | | (a) Except as provided by Subsection (b), a state agency may not |
---|
39 | 39 | | purchase a lawnmower or other landscaping equipment unless the |
---|
40 | 40 | | lawnmower or equipment is powered by propane or natural gas or is |
---|
41 | 41 | | electrically powered. |
---|
42 | 42 | | (b) The comptroller may exempt from the requirements of this |
---|
43 | 43 | | section a state agency that submits written justification |
---|
44 | 44 | | demonstrating the reasons a propane, natural gas, or electrically |
---|
45 | 45 | | powered lawnmower or other landscaping equipment does not fulfill |
---|
46 | 46 | | the required functionality of a gasoline or diesel-powered |
---|
47 | 47 | | lawnmower or other landscaping equipment. |
---|
48 | 48 | | SECTION 3. Chapter 2166, Government Code, is amended by |
---|
49 | 49 | | adding Subchapter M to read as follows: |
---|
50 | 50 | | SUBCHAPTER M. BUILDING ACCESSORIES |
---|
51 | 51 | | Sec. 2166.601. PAINT. A state agency in the executive |
---|
52 | 52 | | branch of state government that owns, operates, maintains, or has |
---|
53 | 53 | | charge and control of a building shall, when feasible, require |
---|
54 | 54 | | paint purchased for a new facility or for a remodel, repair, or |
---|
55 | 55 | | renovation project to be a zero or low volatile organic compound |
---|
56 | 56 | | paint. |
---|
57 | 57 | | Sec. 2166.602. CARPET, CARPET BACKING, AND CARPET TILES. A |
---|
58 | 58 | | state agency that owns, operates, maintains, or has charge and |
---|
59 | 59 | | control of a building shall, when feasible, require carpet, carpet |
---|
60 | 60 | | backing, and carpet tiles purchased for a new facility or for a |
---|
61 | 61 | | remodel, repair, or renovation project to contain postconsumer |
---|
62 | 62 | | recycled content that meets the Carpet and Rug Institute's Green |
---|
63 | 63 | | Label standard. |
---|
64 | 64 | | SECTION 4. Section 2158.301, Government Code, as added by |
---|
65 | 65 | | Chapter 262 (S.B. 12), Acts of the 80th Legislature, Regular |
---|
66 | 66 | | Session, 2007, is repealed. |
---|
67 | 67 | | SECTION 5. This Act takes effect September 1, 2009. |
