88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2158.301, Government Code, as added by
1010 Chapter 939 (H.B. 3693), Acts of the 80th Legislature, Regular
1111 Session, 2007, is amended to read as follows:
1212 Sec. 2158.301. ENERGY CONSERVATION: APPLIANCES, PRINTERS,
1313 AND PHOTOCOPY MACHINES. (a) Unless the comptroller approves a
1414 written request from a state agency for an exemption from the
1515 requirements of this subsection [If available and cost-effective],
1616 a state agency shall purchase equipment and appliances, including
1717 printers and photocopy machines, for state use that meet or
1818 exceed[:
1919 [(1) the federal energy conservation standards under
2020 Section 325, Energy Policy and Conservation Act (42 U.S.C. Section
2121 6295), or a federal regulation adopted under that Act; or
2222 [(2)] the federal Energy Star standards designated by
2323 the United States Environmental Protection Agency and the United
2424 States Department of Energy.
2525 (b) A printer or photocopy machine purchased by a state
2626 agency must have duplexing capability and the ability to be
2727 programmed to default to double-sided printing or copying.
2828 (c) A state agency printer or photocopy machine that has
2929 duplexing capability shall be programmed to default to double-sided
3030 printing or copying.
3131 (d) The comptroller shall collect data on appliances
3232 purchased by state agencies and on the energy efficiency of the
3333 appliances.
3434 SECTION 2. Chapter 2158, Government Code, is amended by
3535 adding Subchapter G to read as follows:
3636 SUBCHAPTER G. LANDSCAPING EQUIPMENT
3737 Sec. 2158.351. PURCHASE OF LANDSCAPING EQUIPMENT.
3838 (a) Except as provided by Subsection (b), a state agency may not
3939 purchase a lawnmower or other landscaping equipment unless the
4040 lawnmower or equipment is powered by propane or natural gas or is
4141 electrically powered.
4242 (b) The comptroller may exempt from the requirements of this
4343 section a state agency that submits written justification
4444 demonstrating the reasons a propane, natural gas, or electrically
4545 powered lawnmower or other landscaping equipment does not fulfill
4646 the required functionality of a gasoline or diesel-powered
4747 lawnmower or other landscaping equipment.
4848 SECTION 3. Chapter 2166, Government Code, is amended by
4949 adding Subchapter M to read as follows:
5050 SUBCHAPTER M. BUILDING ACCESSORIES
5151 Sec. 2166.601. PAINT. A state agency in the executive
5252 branch of state government that owns, operates, maintains, or has
5353 charge and control of a building shall, when feasible, require
5454 paint purchased for a new facility or for a remodel, repair, or
5555 renovation project to be a zero or low volatile organic compound
5656 paint.
5757 Sec. 2166.602. CARPET, CARPET BACKING, AND CARPET TILES. A
5858 state agency that owns, operates, maintains, or has charge and
5959 control of a building shall, when feasible, require carpet, carpet
6060 backing, and carpet tiles purchased for a new facility or for a
6161 remodel, repair, or renovation project to contain postconsumer
6262 recycled content that meets the Carpet and Rug Institute's Green
6363 Label standard.
6464 SECTION 4. Section 2158.301, Government Code, as added by
6565 Chapter 262 (S.B. 12), Acts of the 80th Legislature, Regular
6666 Session, 2007, is repealed.
6767 SECTION 5. This Act takes effect September 1, 2009.
