7	7	relating to a declaration of origin.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Title 6, Civil Practice and Remedies Code, is
10	10	amended by adding Chapter 140 to read as follows:
11	11	CHAPTER 140. DECLARATION OF ORIGIN
12	12	Sec. 140.001. DECLARATION OF ORIGIN ESTABLISHING PLACE AND
13	13	DATE OF BIRTH. (a) An individual may establish the individual's
14	14	place and date of birth by obtaining a declaration of origin from a
15	15	court as provided by this chapter.
16	16	(b) An order by a court under this chapter establishing an
17	17	individual's place and date of birth establishes the individual's
18	18	identity for purposes of the state or a political subdivision of the
19	19	state, and for purposes of the federal government, or any official
20	20	of this state, a political subdivision of this state, or of the
21	21	federal government, in the same manner as a driver's license or a
22	22	personal identification card issued by the Department of Public
23	23	Safety.
24	24	Sec. 140.002. COURTS WITH JURISDICTION TO ISSUE
25	25	DECLARATION. The following courts have jurisdiction to issue a
26	26	declaration of origin:
27	27	(1) a statutory probate court;
28	28	(2) a statutory county court with probate
29	29	jurisdiction;
30	30	(3) a constitutional county court with probate
31	31	jurisdiction; and
32	32	(4) a district court.
33	33	Sec. 140.003. PETITION. (a) An individual may request a
34	34	court to issue a declaration of origin by filing a petition with the
35	35	court.
36	36	(b) The petition must be in substantially the following
37	37	form:

72	72	Sec. 140.004. FEE. (a) The fee to file a petition for a
73	73	declaration of origin is $25.
74	74	(b) A court shall waive the fee for an individual on the
75	75	filing by the individual of an affidavit of inability to pay the
76	76	fee. If the individual does not have the capacity to complete and
77	77	submit the affidavit in the individual's own behalf, a person
78	78	related to the individual by consanguinity within the third degree
79	79	as determined under Subchapter B, Chapter 573, Government Code, or
80	80	a person authorized by the individual to act on behalf of the
81	81	individual, may complete and submit the petition.
82	82	(c) The affidavit of inability to pay the fee must be in
83	83	substantially the following form:

163	163	Sec. 140.005. PROOF. (a) A court shall issue a declaration
164	164	of origin for an individual if the court finds that the individual
165	165	has shown by a preponderance of the evidence the individual's place
166	166	and date of birth.
167	167	(b) An individual may satisfy the showing required under
168	168	Subsection (a) through:
169	169	(1) the sworn testimony of a witness; or
170	170	(2) affidavits from two or more credible witnesses who
171	171	have knowledge of relevant and material facts concerning the place
172	172	and date of birth of the individual.
173	173	(c) An individual may also submit any other relevant and
174	174	credible evidence to the court, including:
175	175	(1) a family Bible or other central text of a religion;
176	176	or
177	177	(2) a marriage certificate.
178	178	Sec. 140.006. ISSUANCE. (a) A declaration of origin for an
179	179	individual issued by a court must establish the individual's place
180	180	and date of birth, including, if applicable:
181	181	(1) the city or county, or both the city and county, of
182	182	birth;
183	183	(2) the state of birth;
184	184	(3) zip code information; and
185	185	(4) location of birth in a territory of the United
186	186	States, a Native American reservation, or a federal military base
187	187	or installation.
188	188	(b) The declaration of origin issued by a court must be in
189	189	substantially the following form:

217	217	the permanent records of the agency.
